As you have phoned and been given this information I would send them a letter telling them of the phone conversation and tell them you want the letter with your offer out to you within 7 days or you will start the court action.0

I think that Nat West are thoroughly confused as to what their line is on this and might make everyone's lives a little easier if they sorted out their charging system in the first place and stopped taking more of our money than they are entitled to!!0 -
So are you saying that you think I should just assume that they are telling untruths and that MCOL is my best next step (without waiting until the end of the 56 days? I am a little scared to go to the next stage and am not sure if I have read enough or know enough about actually taking this to court - I will have to do a bit more homework so that I feel less anxious about it all!!
Being a basically honest person I find it really worrying that NatWest seem to have no qualms about encouraging their staff to confuse/tell lies to customers... the chap in Customer Relations really did sound sincere!!What a way to run a business!!

I agree entirely with the advice Edinburghlass had given you.
When I spoke to Natwest on that last occasion (when they said it could take up to 56 days to send me an offer letter) I did repeat my earlier conversations, and said that I intended to pursue my claim through the County Court. He was very pleasant and said that I was within my rights to do so.
I think the banks are totally deluged with claims and there's probably a lot of confusion about where individual cases are up to. I think the people on the 'front line' answering our calls are probably doing the best they can with limited information on their computer screens!

Edited to add: if you do decide to go through MCOL there is a lot of helpful info on the Board, and there'll always be someone coming along to answer any questions. I was very nervous about doing it, but got a lot of great advice and support here. If you read up on the process first, you'll be fine!0 -

I'm claiming against Nat West for charges of just under £2,000. I'v had an offer back from the for £1,224. The problem is do you think I should take the offer or should I proceed to the court letter and hold out for the full amount. Anyone been in this position could you advise please. I'm also afraid that if I do proceed for a further amount that my account may be closed as they have kind of hinted this in the letter they sent to me, and I feel it will cause a lot of hassle as we have a lot of standing orders, direct debits going out of this account, including our mortgate.
Any advice much appreciated.

You're entitled to get refunded all of your charges, but some people are happy to settle for less, especially if it avoids the need to go through the courts.
The Financial Ombudsman takes a dim view of banks closing the accounts of customers who've rightfully reclaimed their charges. If they tell you thats what they're intending to do, you should report them - you may well get compensation for the inconvenience, and the bank should give you at least 30 days notice so you can set up other arrangements. It could be a good idea to set up a new account, just in case its needed.

I sent off my original request on the 26th Feb and had half of my requested statements through after a couple of weeks. I am still waiting for the rest to come through and it has now exceeded the 40 day period they are allowed by law.
I contacted the bank after the first lot turned up and they said they would get the rest ordered and sent out but could take 7-10 days. Has now been over 2 weeks since that 2nd request and still nothing so called again and was told that it would take 7-10 days, so I explained to the nice young lady that 2 weeks was in fact 14 days and I had still not had them so she said she would send them out again which would take another 7-10 days. I then told her that I would be reporting them to the ICO if they had not arrived by this morning. No post as yet so filled my complaint earlier today.

This might help someone... my experience of claiming from NatWest:
7/1/07 Sent first letter to local branch.
19/1/07 Received standard 'considering your claim' letter.
5/2/07 Sent second letter warning of intention to proceed to court.
15/2/07 Received another standard 'considering your claim' letter.
28/2/07 Filed with MCOL, and sent letter to Natwest confirming list of charges.
29/2/07 Received offer for full amount.
8/3/07 I wrote rejecting their offer as had since paid court fee.
29/3/07 Rejected their offer in full, plus court fee, due to restrictions about not courting publicity, and them wanting me to pay cheque into Natwest account.
3/4/07 Received cheque for full amount, plus court fee, with no conditions except to end court action.
4/4/07 Sent letter requesting refund for charges applied since original claim.
19/4/07 Filed with MCOL, and sent letter to Natwest confirming list of charges.

I have just spoken to Nat West Customer Relations and they have told me that they are in the process of sending me an offer letter for £1,715 (my claim amount minus the interest)!!!!! My first reaction is to jump up and down...however, I was told that due to them being inundated my offer letter could take up to 56 days to be processed. The process was apparently started on the 23rd March so I anticipate hearing something by the 18th May!!
Am I being fobbed off? Has anyone else been told their letter was being processed and then heard nothing?
I would really love to believe that it is this easy but having read other posts I am not convinced!!!!

I rang the Fatwest too and they told me there was a letter with full offer of settlement dated 2nd April on the way to me and should take 21 days (no idea why Royal Mail take so long :rotfl: ). I have sent them a 14 day LBA and by the time the 15th day comes, it will be past the 23rd April, so if no news I will issue at Court.
I suspect they have been told to say 56 days to people now but as so many people have said, since when did the Bank give us any leeway with payments? I have managed to clear my overdraft and closed my accounts with them now so I am happy to proceed to Courts if needs be, I have set time limits they have ignored them. I know what they do if I ignore them and their time limits!!
If you want to wait for the 56 days and give them a chance then that is your choice and is probably less stressful than starting proceedings! I have decided that if there is nothing by time my LBA time limit is up I am issuing. I am now getting used to the idea of what I will spend the £300 interest on!!!

My situation is that I have sent off for my statements over 40 days ago . Two weeks ago I recieved from 2000 to 2001 , I phoned and asked them where the last 6 years was and was told that they should arrive shortly , nothing has arrived for a week so I later then phoned up 5 days later and was told they would "call me back" , I didnt recieve a phone call and called them up again , they said that the statements are being re ordered and yesterday , guess what arrives... 2000 to 2001 again. So i made yet another phonecall and was told that they will be arriving . I cant see them sending them EVER!.
My account isnt in very good shape , being a student im £600 over drawn and have recently stopped re paying my loan I got when I was 18 for £3000 . Im now 23 and still owe £2200 Ive decided not to make any more payments of the 100 a month as I know im not soley paying intrest. They told me that there going to DEFAULT my account ... Do you think this is effecting my bank charges ? and When they do DEFAULT it will it mean I will be unable to claim the charges back.
Any help much appreicated .
