A few details from that Natwest story

"As such our client must take a commercial approach to such claims," it went on.
That is rubbish. this would have been in the high court so any costs they incurred would have been recoverable from the Claimant had they won. They threw in the towel as they didn't believe the strength of their own case. the response when settling here is a standard non liable response from a lawyer. It was also probably sent without prejudice.
Exactly! with all the profits the bank make you can't tell me that they couldn't have afforded to go to court with this case even if the couldn't recover the costs0 -

i spoke to a very lovely lady a FATWEST customer relations who was very helpful, they have said that they have 56 days to reply to my claim which i told her was not acceptable but she politely told me that i can either stick to my time frame or thiers if i chose thiers and they dont stick to it them i can have them for breech of contract or do it my way and see what happens and how quickly i get delt with. IM kind of in a limbo about what to do, i did check with the OFT and they checked my local branch to see how bad the back log is and she said that yes they do have 56 days to reply and that my particular branch does have quiet alot of claims at the moment.
So what do i do i really would rather not file a claim against them unless they really leave me know other choice, but how long is too long to wait. I do kind of feel unreasonable about saying i want my money back with 14 days because surely everything takes time and if there are thousands of us cliaming it may take a little while.
AWWWW im confused.

I recieved my charges back in Feb 07, full payment for the amount i asked for.Which was paid into my account a few days after.
Today i recieved another offer letter dated 18th april, offering me the money back again????
It seems they dont know what they are doing???
Is this a reply to the second letter that i had sent but they recieved this 2 days after i had accepted the offer as our letters crossed in the post??
But if it was you would have thought they would have checked and seen i had already had the money!
Im flipping tempted to send back this offer and see if they pay out agin, their mistake not mine! But im not that dishonest, just goes to show they have no idea whats going on with claimsProud to be DEBT FREE AT LAST0 -

i filed a claim against Natwest through MCOL and they waited until the last day to defend the case (i am asking for £1,600).
The defence has asked for the following:
1) in relation to each charge please identify
(a) the date when the charge was charged;
(b) the amount of the same;
(c) the reasons given for the charging of the same
2) in relation to each charge please clarify the following: please explain why the claimant contends that the same should not have been charged in this amount and identify the sum the Claimant contends should have been charged.
3)In your claim you state that the charges are: “unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, the Unfair Contract Terms Act 1977 and the common law” and “They must be reasonable under s15 of the Supply of Goods and Services Act 1982”.
Please specify all of the facts relied on by the Claimant in support of the contentions in the above and in particular please identify
(a) the sections(s) of The Unfair Terms Act 1977 (“UCTA 1977”);
(b) the regulations of The Unfair Contract Terms in Consumer Regulations 1999 (“The Regulations”); and
(c) the principles of common law relied upon by the Claimant in alleging that the contractual provision(s) referred to are unenforceable. Please also identify the contractual provision(s) that the Claimant alleges are unenforceable by reference to UCTA the Regulations.[/i][/i]
I am happy with answering number 1 as all i have to do is go through my charges again and list what they ask for next to each i.e. amount, reason, date (thats right isn't it?)
I am unsure how to answer number 2 as i dont know how much i should state i should have been charged.
I have no idea how to answer number 3.
I have until the 24th April to reply to the courts, but if i could recieve some help on this matter in would be appreciated.
p.s It's a great idea to send a list of your charges with amounts and reasons of the charges to the courts before the banks can respond to your claim.
I'm fully expecting Natwest to do the same to me - my claim is deemed served on the 22nd of April. I'll also puzzle on how to answer these questions. It might be worth you posting this on the MCOL thread as I've a feeling this has been discussed already (haven't read all the posts in that thread thought) - click here to go to it.
I also sent the Court the spreadsheet of my charges/reasons, after filing my MCOL claim

I am about to make a claim on the Moneyclaim website. do i put the name and address of the bank i bank with or thepeople i sent my claim letter to?

No, what i mean is do i put the name and account number of the actual bank where i put my money in and take it out?
Or do i file the claim against Natwest's head office address?

hi,
natwest solicitors filed defence last week. then i sent reply to defence, now today 20th april natwest have made an offer by post £2960.65. my claim is £3251.65 plus interest plus £120 court cost. SHOULD I accept or continue through court for small claims date?

Hi,
I think it depends on your personal situation and if you need the money now or could wait. If I take them to Court I will want to go for interest, Court Fee etc and so I would proceed with it. I presume it is a tactic to offer just before Court Allocation to frighten??
If I was you, I would refuse and continue claiming the remainder, just my opinion though
