  • hi all, new to the forum but have been researching the posts for a while. had statements from natwest on 30th march charges totalled 2300!! sent off letter asking for refund next day. the 14 days are up v.soon and had no reply at all, does anyone think should allow more time because of the easter hols or carry on with the timescale? also know they have a huge backlog!!!!

    Quite straightforward, no delaying tactics from NatWest. I think the only delay in them making the offer was down to their own backlogs.

    I sent the first template letter requesting 6 years statements etc. the letter was sent recorded delivery and was also sent to my self and remains unopened. the letter was signed for by HSBC and after the 40 days have recieved no reply or acknowledgement. I followed the step by step guide on the main website and gave HSBC a phonecall to prompt a reply.

    My call was put through to the Branch liason Department who said the letter has not been recieved as it is not shown on the computer system and there is a huge backlog of claims.

    I stuck to my guns and stated the the 40 day period under the data protection act had now expired and i would be filing complaint with the Information Commision.

    The HSBC responded with " i will send you the 6 years bank statements to you" . this was today.

    the initial letter was signed for by an employee recognised by the bank.
    and proof of signature is recorded on the royal mail website.

    what do i do if i dont recieve the 6 years records soon.??

    Only you can decide wether or not to give them more time, it's personal choice, your timescale. It's not unusual not to have heard anything, don't worry ;)

    hi all,
    wonder if anybody can help me..
    i sent my 1st letter plus list of charges to natwest y'day.. i realise it could go to the court stage but i thought it was just a case of filing a cliam, get a date and turn up with my bank ststements..but now after reading more in the issue im totally lost,, what does judgement by defaulf mean and they get 28 days to do what??
    could somebody please talk me through the court process from the start when i first register on mcol..in simpke terms as i really dont understand this..thank you so so much..

    Quote.....If you don’t get a reply for statements, follow up with a phone call (which you have already done) and then report it to the Information Commissioner for a breach.

    You can also write the following template letter (thanks to Rex Mundi) ........

    "ACCOUNT NUMBER XXXXXXXX

    I sent a letter and £10 cheque on the [insert date of first request] requesting six years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the D.P.A. As yet I have not received any correspondence from you.
    By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.

    I look forward to your timely response.

    Find enclosed a copy of my original letter."

    Ok my turn to be nosey ;) hello, how long was it from start to finish? (just wondering if you started the process post/pre TV programmes.

    I want to claim back charges from natwest, but i have a loan with them. If im successful, can they take the charge refund to pay off the loan?:confused:

    They shouldnt as the loan is a seperate agreement but they may well try since they do have the right to 'set off'. As it stands now the money taken would have to be 'due and payable' and they could only take any missed monthly payment if applicable and not the full balance of the loan. You can challenge them if they try to do this. See here for more information:

    They could only take the full refund if they officially recall the loan before refunding charges. If the loan is offically recalled it would be in retaliation for reclaiming charges and solely to retain any refund of them due to you, obviously.

    Complain to the Financial Ombudsman about this and any issue surrounding their taking the refund against the loan. As regards payment of the loan after recall you retain the same rights as a debtor as usual with payments calculated on your income and outgoings. They can demand full payment but they cannot expect it.

    Get a 2nd opinion on this, preferably from the ombudsman, as each case is different and personal circumstances differ. The more information you have beforehand the better and good luck :)
