PAWI69,
Thanks for that - I will send the court proceedings to the local branch and see where we get from there. Thanks again.0 -

.....It did really make me smile though to think of 2 trailers of letters reclaiming bank charges, and all those people pulling their hair out:D .
I know it is quite cruel of me, but when I think back to all the times I was really struggling, pulling my hair out and the bank just kept putting on the costs. I have to say that what goes round comes round.;)

Oh I so agree with you! And I'd love a photo of those trailers - hope they've put a tarpaulin over them :rotfl: :rotfl:

I've just checked my credit card statement online and discovered a late payment "fee" of £12.
I made payment before the bank holiday but didn't allow enough time for the for the three working days the bank takes to transfer money from my Natwest current account to my Natwest credit card account. (Where did it go?)In the past, when this has happened, the fee was refunded. This time I was refused.
Almost too eagerly, I have fired off a template letter requesting a refund relishing the prospect of taking on the bully-boy racketeers.
Now I am wondering whether this is the opportunity to get the banks into court to justify their charges.
I believe that others have successfully claimed interest on the fee but could I make a further claim for damages or somesuch. The bank could perhaps reasonably dispute the damages as excessive but only if they attend court to do so. Would this be the opportunity for the courts to establish a precident that the banks have sought to avoid?0 -
Hi I am new to this and have been reading through what some of you have put I am with Natwest and was in difficulty last year and borrowed to get out of it, but the charges of £38.00 a time is crippling I only do 16 hrs plus get tax credit and I added up from june last year 06 till now april 07 in them 11mths I have been charged £1,260.00 so I have asked for the last five years statments and waiting for them to come and am going to be sticking in there. julie.
The bank are not allowed to take your tax credits or any other means tested benefit, I've been looking on this site for ages to see what you can do & I found a post by Twinkly (hope she doesn't mind me quoting her), you can write to your bank & complain, here's what she said......
write to your bank & quote the following in the letter:
Social Security Administration Act 1992
Miscellaneous
Certain benefit to be inalienable **
187- Subject to the provisions of this Act, every assignment of, or charge on-
(a)benefit as defined in section 122 of the Contributions and Benefits Act;
(b)any income-related benefit; or
(c)child benefit,
and every agreement to assign or charge such benefit shall be void; and, on the bankrupcy of the beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors
Taken from a template here:
http://www.consumeractiongroup.co.uk...-benefits.html
The template must be amended to suit the name of your benefit and apparently must be sent in each time there is a payment due in to stop them taking anything from it, but that it worth the hassle to stop them.
They are breaking the law taking social security benefits. Good luck0 -
