    Anybody?

Do I just wait for the allocation questionnaire from the court or do I need to provide Cobbetts with full details of my claim (again)?

    Thanks!

    Hi

If you look back through the posts (a few weeks ago I'm afraid) there is a letter that someone suggested writing to Cobbetts (with a copy to the courts). You actually don't need to send them the information they are requesting as what the CPR pt 18 or whatever it is doesn't apply to the small claims track anyway.

Just fill in the AQ as set out in the instructions and everything should be fine

The stupid thing is, they only have until Thursday when the 28 days will expire for the small claim i have started, so i will win by default unless they send me a cheque for the full sum anyway!!

They are well known for filing acknowledgement and defence right at the last moment!! Did it to me on both just as I though I would win by default as well!!

yes, they attached my original first request letter for my statements, not a photocopy because my signature is my ink lol

I will just ignore it because it doesnt really make sense, and I am going to ring customer relations tomorrow too...

I take back what I said, just never heard of a letter like that, consider me shut up ;)
  • OK This isn't meant to sound horrible to anyone but...

If you read through this whole thread there is all the information that you will need to complete the claim from start to finish.

I just find it a little frustrating that people seem to ask questions that have been answered many times over.

It took me hours to do when I started but I figured if I was going to do this I wanted to know exactly what I was getting myself into. (And I do work and have a baby to look after so its not like I have a huge amount of spare time to do it in!)

Sorry just a bit of a nag!
  • I'm new to all this forum lark so sorry if I get anything wrong. I've read that some people are having lots of trouble with other banks and Natwest seem to be the most reliable to claim back charges aside the people who have experienced trouble with them. I am with Natwest and have sent off the 1st letter recieving a letter about a £5 fee to cover the statement reprint. This was all done and dusted for which I recieved the reply of "manual intervention" and only the first year of my statements. Now I was wondering if this was normal or should have I recieved the full 6 years in one go? I'm just left wondering if I get all the other statements when they feel like sending them to me or do I have to get in touch with them to tell them I need the remaining 5 years? If I need to get in touch with them does anyone know a number or address I could use to contact them because I can't find one anywhere?

I would be most grateful of any help.

I think people just panicking a little and want answers quickly. I have queried the Defence and Request for Further information and have put Cobbets on the search engine but havnt had much luck. Perhaps, as people are new to this, it just takes a while to get used to the threads and thats why the same questions seem to be cropping up all the time.
Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

I think I have seen somewhere on one of the threads that you have actually received payment from Cobbetts. I have received their Defence and Request for further information quoting CPR 18 etc. Did you have to fill this in or did you just provide copies of everything which had already gone to the bank? JG

    Hiya :)

I'm sorry but I've only had a verbal offer over the phone, I haven't got as far as the court stages as yet, although that date is very close, natwest haven't replied to a single letter.

I was going to ask on another thread about your questions on Cobbetts but I saw you had already been & asked, Edinurghlass answered you.

Don't worry about asking questions that you may think have been asked before, I've read almost everything I can on MSE about bank charges but there's no way I can remember everything or indeed what part of the site I saw it on, thats what people are here for......to help in whatever way they can ;)

Feel free to ask whatever you wish, someone will be along at some point to try & help you. Keep us updated & good luck with the form (most natwest claimers have to fill it in, I'm dreading it but I know there's help at hand if I need it).

Some have been lucky enough to have recieved all statements at once, some in dribs & drabs, some none at all.

I have read that the same happened to someone & they rang their branch & the statements were ordered there & then, if you don't get any joy, try 0800 015 4212, or, report them to the financial ombudsman if you haven't recieved them within the 40 day deadline.

Good luck, let us know how you get on :)
