You must send the letter before action telling the bank you will give them 14 days or you will take them to court. All templates are in Martin's article as below.

I was generous and gave them a further 7 days after the 14 day letter had been received (see letter above). But it did me no good. I had to go to court.Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

I'm in the midst of this and a tad confused.
Basically I've opened my parachute account with SMILE and they now look after all of my banking affairs.
I've calculated my charges and interest and written to my NatWest Branch on 7 March including copy of spreadsheet and allowing 14 days for reply - no reply
I wrote again on 27 March saying if no reply in further 14 days I will take to court. I stuck with original figure even though now an additional 20 days interest has been gained - 14 days is up today and still no reply.
I'm going to give til Thursday (as we've just had bank holiday) and if no reply I'm going to start the court process.
Here are my questions:
1 - Have I done anything wrong so far?
2 - The total figure keeps changing as time is going by and interest is being added daily. In the letters should each time I send one put the NEW total figure or stick with the original?
3 - When I apply to the courts should I put the NEW total figure or the amount I originally asked NatWest for?
4 - Has anyone else tried NatWest and have they too be ignored or did they get replies to their letters? Is my branch perhaps just being useless and not following suit or is this normal for them? I've addressed all correspondence so far for the attention of my branch manager.
I'd really like some help with this before I start the court process on Thursday.
Many many many thanks someone, everyone, anyone.0 -
Hi
I sent my letters to Natwest claiming back £1810 worth of charges.
I sent my first letter on the 28th Febuary and it ended with me putting in a claim on the small claims website- end of march time.
I then received the long winded letter stating that as a good will gesture they will give me the £1810. I was over the moon- obviously so i rang them to check my account( I have changed to Lloyds TSB and I no longer use natwest, I had a loan to cover my over draft which im still paying off at £90 per month, I dont have any debit cards or anything to access the natwest account- they took them off me!) Natwest told me that the money from my charges would be paid into my account but it would be used to clear the outstanding balance on my loan £1800.......
Can they make me do this?? Its really stressing me out...
They also have until the 16th to put in a defence, can I ignore this letter and let it go to court?
I really need help on this....please!!!0 -

Help! Getting a bit jittery now! Nat West have defended my claim. I have received a huge amount of paper work from their solicitors Cobbetts in Manchester. There is a defence and a Request for Further information which goes on about responding to their request "in accordance with CPR Part 18" etc etc. I have to reply by 18 April. Any tips for filling this in and does this mean they will defend this in court? Any help really appreciated. JGNat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -
ALSO.....
Not sure if this covered somewhere else so sorry if it is but have heard there is someone taking NATWest to Court this Friday [good luck to whoever it is!!!!]. If this person wins his case, what, if any, effect will it have on others claiming now?
