Hi im in the same sort of situation. I have an current account with 1200 overdraft that i can not pay off, i have at least 900 worth of bank charges and would like to know if i have to close my account or ask them to take it off my overdraft

Hi - some people ask for cheques, and others are happy for refunded fees to be paid back into their current accounts. I'm quite happy for them to pay it into my current account so that I can greatly reduce my overdraft.

I'm i the midst of this and a tad confused.

    Here are my questions:

1 - Have I done anything wrong so far?

2 - The total figure keeps changing as time is going by and interest is being added daily. In the letters should each time I send one put the NEW total figure or stick with the original?

3 - When I apply to the courts should I put the NEW total figure or the amount I originally asked NatWest for?

4 - Has anyone else tried NatWest and have they too be ignored or did they get replies to their letters? Is my branch perhaps just being useless and not following suit or is this normal for them? I've addressed all correspondence so far for the attention of my branch manager.

I'd really like some help with this before I start the court process on Thursday.

Many many many thanks someone, everyone, anyone.

    Hiya,

    1. You havent done anything wrong so dont worry, but be careful with the interest, you can only claim it if "their charges" took you overdrawn if you know what I mean.

    2. In the letters to the bank I'd amend the figure & tell them why.

    3. Put the new figure when you apply to the court as you have already informed the bank.

    4. I addressed both my letters to my branch, they filtered through to the right department in the end, although since then I've found out the correct addresses are either Borehamwood or Edinburgh, mine got there anyway. I rang customer services & got a verbal offer but still waiting on any sort of letter from them.

This is purely my opinion, if I'm wrong then someone will be along to correct me, until then, chill out, put your feet up & have a drink :) hope this helps somewhat, good luck & keep us updated.

    Port sunlight??

    Had a letter this morning:

"we refer to your attached correspondance requesting a complete list of transactions and charges applied to your account under the data protection act. In order for us to progress this request please supply us with the following:

Please refer only to the ticked boxes:

    (briefly)

    a. the fee is £5, please supply a cheque
    b. we have a different address on record, please confirm
    c. it is not possible to trace the account, please confirm details
    d. please provide signature to verify your account
    e. we return your cheque as the fee is £5, please amend
    f. Account is not in your name, please provide authority...

First off, none of the boxes were ticked, and second off, this letter is regarding the statements that I recieved on 9/3/07 so what is this letter all about?!?

can anyone shed any light on this letter?

You might struggle to convince a judge if you refuse the full amount even if it is used to pay off your debt to them. Its a new one to me, wouldnt you rather be £90 better off a month? Its your call... Good Luck
Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.
:o Feel free to thank me if I was a help :o

I am hoping to try and spend some time in front of my computer tomorrow so could anyone shed any light on where to get help regarding filling out the forms as Nat West have defended my claim. I have received a huge amount of paper work from their solicitors Cobbetts in Manchester. There is a defence and a Request for Further information which goes on about responding to their request "in accordance with CPR Part 18" etc etc. I have to reply by 18 April. Any tips for filling this in and does this mean they will defend this in court? Any help really appreciated. JG
Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

I thought so, just wasnt sure if anything would go against me if I just ignored the letter, but as none of the boxes are ticked and I have already recieved my statements, probably best to just ignore the letter.

And I work in Birkenhead so am regularly in the hamilton square/charing cross branch, I just signed up at port sunlight a few years ago lol
