    I dont want to start my claim pay the £120 and then the next day receive the letter from Natwest which seems to be whats happening. Because if we start proceedings, pay the fee and then cancel I doubt we get the fee back.

    But then again like you if I do file with MCOL then I can claim the £2700 + interest.

    Hmmmm decisions decisions. I think im going to hold on to the hope that I will hear something before Friday and before I have to make the decision, ha ha ha!

    I have a 6k + 2.2k claim in with NatWest. They offered me 4.5k but were after the deadline I had set so I have already started my claim with MCOL.
    The total I am claiming is no in the region of 8.5k including MCOL costs.
    They have ackknowledged the claim and at the last moment put in a defence.
    I have received a long letter from Cobbetts (their solicitor) with their defense outlined in dense legaleese. They have also requested further information which I had already sent to them.
    I understand that because the amount is above 5k it will now be moved to my local court.
    Does anyone know:
    What the time scales are from this point?
    What risk I am running by carrying on? Are they just bluffing? Will I end up with a huge bill for costs?

    It all seems a bit scary now. Am I right to carry on?

  • Can anyone tell me how long it is roughly taking for natwest to make an offer, i hand delivered them my letter on the 4th april im claiming for just over 3,000 but in oct 04 i paid nearly 800 in charges in that month, they told me that i have no other choice but to take a loan out with them for 1100.00 over 5years i stupidly agreed to this i at the time i didnt know any better, the problem i now have is that if i hadnt of had those charges then i would never of needed a loan so can i claim back my loan aswell as the bank charges?????

    The banks make me so mad - they pile on these charges and get us into debt, then have the cheek to offer us a loan so they can get even more money ie in interest, out of us. :mad:

    I am due to fill the claim with the small claims court on friday, but do I give them a bit of extra time as they said it can take 8 weeks to get a response??

    I go along with everything that Paw169 has said - its just a personal decision whether or not to stick to the timescales as recommended on here.
    I'm due to do the MCOL thing a week today - but I'll probably ring that number next Monday to see where they're up to. I know they have a huge backlog of stuff to get through, but in my mind they've inconvenienced us enough already, so I'm not very patient with them !! You need to do what you think is best - no right of wrong answers on this one.

    Hi, as per my previous post, I waited a month after sending the 1st letter and then phoned them on the number you give, they said they were dealing with it and I got their offer letter 7 days later, dated 2 days prior to my phone call! I'd say wait another week, it's a pain, but it won't cost you to wait a touch longer.

    Hi, Claiming from both my husbands and my account and was both told on the same day that offers would be in the post by the end of the month (March), I started the claim for my account on the Monday and got an offer letter by the end of that week but my husband still hasn't had an offer letter so we started his claim middle of last week.
    I really believe that it could be swings and roundabouts where Natwest are concerned. The only thing I can say is don't always believe everything that they tell you!!!

    I agree, swings & roundabouts it definitely is, which is another reason why I'm in 2 minds about waiting or MCOL.......bit like "daddy or chips" ;)
