Just a quick update,
Sent letter requesting statements 19/02/07 got them on 12/03/07 in a battered torn envelope so the postie could see my financial state :mad:
Sent 1st letter requesting my charges 16/03/07 of £4***.** heard nothing
Rang customer relations & they had nothing on their screen about my case :eek:
Sent 2nd letter requesting my charges & threatening court ect 30/03/07 (less than a week ago), just rang them out of curiosity), had a verbal offer of the FULL amount! (must say the girl on the phone was lovely to talk to).
I was told it will take up to a month to get the letter to me as it has to go through different departments, typed up, verified, checked ect ect, due to the high demand it is taking longer than usual to process claims. When I get the offer I have to accept & sign & send it back, then wait a while longer for it to be deposited in my account :rolleyes:
I'm due to file with MCOL in just over a week, so I think I'll give them a while longer out of courtesy on my part
I'm not counting my chickens before Easter...oops I mean before they hatchbut I'll let you know as & when I do.
Hope this helps anyone, especially those worried about claiming larger amounts. My hubby thought I was flogging a dead horse & was wasting my time (I was beginning to think he was right), but you don't get if you don't ask, it's our money after all & thanks to everyone who has supported & advised me this far :T0 -

I'm hearing a lot how pleasant these people are, when we ring to get progress on our claims, and that was certainly my experience also. A few yrs ago, when they were piling charges on me (£240 on one month alone) and I rang and pleaded with them to put things on hold, all I seemed to get were patronising and at times very rude staff who basically told me it was all my fault. Wonder why the attitude seems to have changed so much? Unless it's simply that those on high realise the game's up with their charging, and have told their frontline staff to be pleasant with us.
I'm tempted to give them a bit longer before I start MCOL, but then I remember that desperate few months a few yrs ago, when they seemed to delight in piling the pressure (and the charges) on me. I'm thinking I might just go ahead with MCOL when the 14 days I've given them is up - I think I'd quite like to get interest back on the almost £1000 they owe me.
I'll ponder on that one....:think:

Hi,
Long story, but basically have had an account with Natwest for 3 years, got into some finicial difficulty and got charged alot for cheques bouncing and returned DD etc. 6 months ago was £1400 overdrawn with no overdraft facility so they froze my account and passed it to credit management. I set up a payment plan with them and have being paying £50 a month and have another bank account.
After reading the bank charges stories I decided to investigate myself. I got all my statements and it worked out that I had been charged over £2500 in charges and interest, so I put the wheels in motion on the 13th March with the first letter asking for a refund and heard nothing so last friday I sent the 2nd letter givig them 14 days to pay up or I would start court proceedings.
Have still heard nothing so today I rang Natwest just to make sure they had received my letters (as I had hand delivered them to my branch.) They put me straight through to credit management, who said they hadnt received the letters and I should of sent them to them as they are holding my account. They said that my balance is still £1000 but if I can pay in the next 28 days they will accept a settlement "deal" of £500. But when I enquired further about my charges complaint, the very rude lady said that the amount I quoted her as being owed (the £2700) was no where near any charges I had been charged and that the stories in the news were only about charges being charged whilst in debt with the bank nothing else. Basically I think she was saying that I was not entitled to claim for a refund in charges as my account is with credit management, i think, it was all very confusing.
I am very confused, I basically told her to put the offer in writing to me and I would look into it, but if I accept this does it sound like I am accepting it instead of the refund of charges, also do I re-send the letters, ring again and speak to someone else?? Im just not sure.
Finally the banks 14 days that I gave them to refund the charges is up next week, do I continue with court proceedings or not??
If anyone could offer some advice I would really appreciate it because I am very very confused and do not know what to do next.

IF IT WAS ME.....if I was in a position to pay the settlement figure of £500 within 28 days, I would. Then I would carry on with reclaiming MY £2700.00 as it's not in the hands of the debt management anymore.
Regardless of what she said to you on the phone, you (as well as everyone in the land) have the right to reclaim unfair bank charges going back 6 years.
Think of it this way, would you of repayed the amount owed on the debt if you got your charges back? personally I would have.
In your case I'd follow the steps on reclaiming to the letter & to the minute, if the 14 days are up then file with MCOL as you are just getting passed to the debt management team on the phone, I'd not phone them anymore, just send your letters, file with MCOL ect ect. If it gets to the court stages you can claim charges plus 8% interest from the date the charge was applied to your account AND all your court fee's.....lets see who's worried then, certainly not you!.
This is purely my opinion, maybe someone will be along to offer more advice, didn't want you thinking your post was forgotten about.

I don't know but it doesn't sound like they have sent you what you asked for, I'd give them a call to clarify this. Maybe you will get someone on the phone who is more helpful than the person who sent you what you got. Good luck, let us know how you get on.0 -

First time on here, have been reading all your stories and didnt realise they would try and fob people off with so much crap. iIhave got my bank statements and worked out they owe me just under £2000, although over the years when i have kicked up a fuss they have refunded some, just under £500. How should i add this in the letter without them thinking they have done me a masive favour and try and shoo me away? Any replies would be a great help as i am hoping to send letter asap. Danielle0 -

Hi & welcome, I too have had the odd charge refunded over the last 6 years, when I calculated my charges I didn't include them, I also didn't mention this in any letter as I thought there was no need to do so. Im sure you thanked them at the time for "the gesture of goodwill" with the £500 of refunds over the years. Just send the template letter as set out in Martins article omitting the refunds & don't mention them. Hope this helps, best of luck0 -
Thanks for advice, i added my refunds to the template but i am now going to change it! I am so determined to go for this even more so since the other day i was pleading with a guy from Natwest about a bank charge and when i said i could see why people were trying to get bank charges back he almost laughed and told me to go ahead and try. I will keep you posted as to how it goes!0
