1. The court allows 5 days for the claim to be deemed served. So the 14 days only start on 24 March, giving them until 7 April to acknowledge. If they don't, you can order judgement by default. If they do, that gives them an additional 14 days to put a defense in. If they don't, you can order judgement by default. If they do, they will most certainly not want to go to court, but you will have to fill in an Allocation Questionnaire. Only then would you have to provide additional information to the court.
2. Yes you should respond and say you want the full amount. You could say something like this:
"I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee."
3. Yes. They want you to go away.
4. They have to acknowledge the court claim on MCOL online, you will automatically see it when you log into your claim. They can send you as many letters as they like - the online acknowledgement is what counts. The court will also send you a letter saying they have acknowledged.
5. See above. Your claim will be with Northampton Court by default and go to your local county court if a court date has to be set.Reclaimed thanks to this site:

I would advise giving them a call. I sent 1st letter 26th Feb and sent follow up letters in the recommended timescale. I had heard nothing so decided I would give them a call. Called Natwest Customer Relations Unit (08000154212 press option 1) to be told they had made a decision and an offer letter would be sent to me. I asked when I should expect to get the letter and the very kind but extremely frazzled lady told me it would be at least a fortnight but more likely longer.
I advised her that I was still going to persue through MCOL and she said most callers say the same thing. She said too many valid claims and not enough staff to deal with the back log!!!
Well, I'm still pursuing the refund of my bank charges. They didn't acknowledge my first letter, so have sent the 2nd one threatening court action. Must say, I'm dying to know where things are up to - might bite the bullet and phone them tomorrow :eek:
Anyway, I'll keep on with the process til the cheque's in my hand or the money's in the bank!! Hope you get your money!

Thanks all you've just given me the inspiration I need. Received my statements from Natwest quite quickly (posted the letter to the Edinburgh address, Mr Lyons).
Have calculated and with the interest it is a whopping £4187 :eek:
Could anyone tell which is best to send the letter for charges to my branch or to the Edinburgh address again.?0 -

Either/or. Your branch will only send them on to Edinburgh for you.

In the same situation, 2 letters no response so filed MCOL then offer letter arrived, signed and returned but as yet still no funds. I keep phoning them it hasn't got me anywhere yet but I will try again today. By the way my claim was for £7521, and they offered the full amount!!

Just called Customer Relations again and instead of being told that the money will be in my account within 7 to 10 days I am told that they have 14 working days to credit my account :mad:
They just seem to take longer and longer, their delaying tactics are just going to make the court date closer and then they will have to pay out the interest and the court fees too.0 -

Just follow the instructions on this website. A lot of people are ringing NAtwest but personally I think that just complicates matters. I only ever received one acknowledgement letter from them and that was 2 months after my original letters. Just stick to the timescales on this site.0 -
banks have Never ever showed up for ANY court cases and are paying up - some banks are making it more difficult than others - so my advise is read succes stories and get motivated and start proceedures to get your money back

Thats not stricltly true as there was the one case where the banks won in court - look back at Rex_Mundi's posts in this thread. But I agree it seems that 99% of the time they settle before a hearing date0 -

Rang Customer Relations this morning - very nice and really helpful lady who said that an offer letter would be sent out week commencing 16th April !! I asked how much, and she said they weren't allowed to say over the phone but more than hinted they'd be offering the full refund of charges ie £925 !!!!!

I hope you receive your letter, I did - but no money yet - my husband still hasn't received one and his was supposed to be sent out by the end of last month!
