hi again p.m.fly, the date of 2 weeks is tomorrow, I was going to ring the branch today, i sent it recorded delivery so ive seen on the web the womans signature, should i ring them today or send the next letter tomorrow?
That is really up to you but personally, through all my claims I stuck to letters only as you don't have proof about what has been said over the phone and they will most likely just fob you off anyway.0 -

I have sent in the letters to Nat. The bank statements missing were issued by Nat West. I paid £5 and they sent say 12 months back to Oct 11th 2002. The Nat West and RBS merged there computer systems around 11/10/2002. Statements prior to that date have to be ordered a slightly different way, i think in 3 monthly blocks.
I have kept to the routine set out in the instructions. That is letter 1. 28/2/07. Letter 2. 14/03/07
And put in court on-line 28/03/07.
Not received anything back from them. Not one letter.
I am sure they only have 14 days from them receiving the court notification, which is about 2 days after being issued.
When 16 or 17 days have passed from 28/03 07 i will request judgement by default if they have not responded.

i have received a verbal offer from natwest today for 1756.00 which is total of my claim less interest.
i have a loan with them which is in collections dept. i have a payment arrangement which is up to date but they say the money will go into this account to reduce my debt to them.
i cant afford for them to do this as i have other stuff to sort out so as i havent had an offer letter (they say it will be up to 3 weeks before i get this) and their time according to my last letter to them is up, can i issue small claim to ensure i get paid by cheque?
im not sure if i can do this as they have offered full amount of charges can i go to court to get interest and ensure chq payment do u think
any advice welcome

Am i write in thinking, After filling out the online claims thing. If the still dont respond within the time peroid, You dont have to go to court and you win by default ????0

I think if you have one or more accounts with them, they can pay in the amount reclaimed to whichever account they choose. If I'm wrong about this, someone will come along and correct me, hopefully. As you have the loan out with them, I suspect they can use this money to reduce the debt.
Stick to the time scale of letters and if necessary pursue your claim through the Courts. Again, I'm not sure about whether you could insist on a cheque, sorry.
Anyway... this bumps up the thread for the evening readers/responders

VICTORY. The bank does nothing. This is a very common outcome; often the bank simply doesn’t acknowledge the claim and this means you automatically win by default 14 days after the claim is served (which takes 5 days). At that point, you must request ‘judgment by default’, this can be done online, and you should do it as soon as possible (get it in your diary and plan around it to the second if possible) after the 14 days ends.

i spoke to three people
1st was the lady who had an offer was going to be made for full amount of charges only as they dont pay interest
i asked her to note i had asked for a chq as the a/c is closed to me
she said if i spoke to cms they would arrange for me to withdraw money once paid in
i rang them and the man said yes thats fine call back when money is in and we will sort it out
i came off the phone and on 2nd thoughts rang back to ask for it in writing
this time i was told by a diff man that no way would this happen it would be taken and offset against the loan and that i had been given wrong info before

Well, Natwest haven't replied to my letter requesting a refund of charges, so I'm now about to send out the letter threatening court action. Am i correct in thinking I give them 14 days til I commence court proceedings? I did check the template letters (which said 14 days) but seem to recall reading some posts where people quoted 7 days. Just want to get it right!

I sent my previous letter to my branch, and think that I'll need to send this next letter to my branch also.
I'm sure I read somewhere on the forum that, if the court ordered the bank to pay up and they defaulted, we could bring in the bailiffs, so it was an idea to use your local branch incase you wanted to see it in action !!
Anyway, I'm sure someone will come along and advise us.
Good luck with your next letter - and hope we both avoid having to actually file a court claim.
