The problem is that they originally sent me an incomplete batch of statements 3 times (I ended up getting just 50 Months). So not wanting to waste anymore time I submitted an estimated claim. All well and good. They then told me that I needed to resubmit it and sent me out another batch (incomplete again) of statements, although they were incomplete they covered a different period to that of my original statements which have been highlighted and sent back as per their requestm, since that time I have been told that they have lost my statements and I need to resend my highlighted list of charges again. Which, due to being an estimated claim and the statements covering a different period, would in all probability work out as a different figure be it more or less.
I am keen to keep this out of court at this point purely becuase I have just moved house and we our pockets are tight enough as it is without having to find £250 to cover my claim (My charges reach over 5k with the 8% stautory interest)
I have logged a complaint with the FSO for this but they have advised me it will be another week before they can process this due the number of complaints they have received.
In all likelyhood I will end up at MCOL, but I simply can't just yet, plus, this claim is a complete mess now with estimates and missing statements etc etc, but after 3 months of waiting I am loathe to start again!

The only thing I can advise is what I would do if I was in your situation.
I would send them another letter threatening court and giving them 14 days to respond. However, as you mentioned earlier, you have received 2 batches of statements but from different times/dates. Make a new list of charges including all dates you have received so far (which you have probably already done) and use this as the total amount you are claiming for from them.

Hi, I have gone through the initial stages of trying to get Nat West to refund my charges sending letters giving 14 days and then 7 days for them to respond but I have had nothing at all back from them!
I made the mistake of not sending the letters recorded/registered post and wonder if anyone can give advice as to whether I should resend both of these letters (recorded) or see if they will confirm by phone whether they have received them? I really don't want to have to give them another 21 days but if that is the best thing to do I will just have to bite the bullet.
Any advice would be helpful - thanks0 -

I started my claim in November and despite giving them extra time over the Christmas period to respond (not deliberately - just forgot!) I never heard anything back and just went onto the money claim stage. To be honest I don't see the point in ringing them - it seems to annoy more people than it helps! I would just carry onto the next stage.0 -
Hi, Just to check, the last letter I sent was the one saying I would commence proceedings if I didn't get a response within 7 days - are you saying that you think I should start my online claim now (I am just worried that they will say they never received the letters and I have no proof!!).

To ring the Customer Relations Dept. and told them I was chasing up regarding my claim as I'd had no response to my letter.
Was told that on the 15th March a note was put onto my account validating my claim and that a letter would be sent out to me in 21 days.
I asked what the next course of action was in the procedure, then she put me through to someone else, who then told me to ring the no again, press option 1 for 'complaints'...I did this and was left on hold for ages, when I eventually got through to someone, she asked was my call in relation to bank charges, then asked me to ring back after 3:mad:
So validating my claim? Does this mean that they accept that I have a valid case? Sorry if come accross as asking a silly question, but i really am unsure how to proceed. Anyone else had this said to them?
Should I give them 21 days from 15th March? That means waiting until 5th April.
I'd really aprreciate any advice / suggestions on what to do next, or not as the case may be.

I shouldn't think this will be too much of a problem - I'm sure this will happen quite a lot.
Anyway if their 14 days is up as it was 2 weeks ago, just send the next letter and sign that one0 -
Just a quick question.
I am aware that companies have to keep certain records for so many years and after asking in my accounts department, they have said anything we have relating to any kind of contract agreement with a customer must BY LAW by kept on record for a minimum of 6 years after expiry.
Does this also apply to banks?
I am asking as Natwest are saying they cannot find details of my account as it is now closed so they have probably discarded my details but they still also refuse to remove any items from my credit file even though they can't prove I had an account with them. Just wanted to know if it was law for them to keep details as it will sound good in my next letter to them0 -
hi again p.m.fly, the date of 2 weeks is tomorrow, I was going to ring the branch today, i sent it recorded delivery so ive seen on the web the womans signature, should i ring them today or send the next letter tomorrow?0
