Following one final call to Borehamwood, in which I was told that my "Lost" statements could be on another site as they sent a batch away to be processed, but they can in no way confirm this. IF they were there, I would then hear back in about 3 weeks, taking the time of this claim to near on 14 weeks! After listening to a myriad of delay tactics, my patience has now been exhausted and I have filed a complaint with the Financial Ombudsman (as I can afford to kick off legal proceedings just yet, but will as soon as I can), although, due to the lack of paperwork that I have received from NatWest, this will apparently be very difficult to defend.

I'll keep you informed of any progress.

    Morning all,

Was wondering if anyone can help.

So far, so good. Called up the customer services number a few weeks ago, copy statements appeared on the door-mat a week later. 13 days ago, totalled up all the charges and interest (using the calculator on this site) which came to £2830 (£2089 ex interest).

Called up Natwest Monday to confirm that they had received my claim (as I accidently sent the letter to my branch). Everything was on the system and a letter of offer for £2089 has been sent out (apparently).

    So....just wondering.
-Tomorrow is the 14 days as stated in my first letter to them for a reply. If I hear nothing back, do I send the second letter (with the court line) back to them Friday morning knowing that a 'letter is in the post'?
-The offer is nearly £800 short of what was requested....do I push for the full amount or a settlement figure? Im in no rush for the money and also have had a bad history with Natwest which included them giving me a loan with a stupidly high interest level.
-Has anyone else got an offer of the amount excluding interest and decided to push for more?

I have a small amount of the loan outstanding but will be closing all accounts with them after this is sorted.

    Thanks

    Phil
  • Hi all

I've sent the two letters (no response) to my local branch. About to go legal with the moneyclaim online route. The total claim is less than £5K before interest but then with interest it takes it to approx £5300. This means my court costs increase to £250 (from £120). I know I can claim this back but does this increase make the claim viewed as potentially not a small claim??

Has anyone had experience of Natwest acting differently with different claim values??

    Hi,

I have received a settlement from Natwest for £2830. I currently have an account with them even though it has gone to the solicitors (i know dont tell me bad lad). Well can they pay you directly? They have told me that they will pay it off my current opened account. Is this true?

    Thanks

  • Hi,

    14/02/2007
I sent two letters to Natwest to claim back my bank charges totalling £1442.00. One letter i handed in at my local branch, the other sent to the head office in Borehamwood (they were both sent on 14/02/07).

    05/03/2007
I got a reply from Natwest offering me $450, i decided then not to accept this and go through the small claims.

    08/03/2007
I submitted my claim online through MCOL on the 8th March.

    16/03/2007
    My claim was acknowledged

    20/03/2007
I have just received two letters through the post today, one from the courts stating the acknowledgement and they have assigned a solicitor to defend the claim.... worries me slightly!!

The other from the head office (Borehamwood) from Natwest offering me £1442.00, but the letter is dated 9th March..... looks like that has been delayed and was sent before i submitted my claim online. Can i still sign the Natwest form offering me the money, send it back to Natwest and tell the courts they have settled (even though they said they are defending the claim, no defense given yet though...)???

or do i have to pursue them through the courts?? would prefere to settle on the £1442.00 they've offered me...

apologies for the long story... better you get the whole picture though!!

In fact as you have been offered the full amount of your claim you must accept this as the interest would only come into play should this have gone to court and the court wouldn't take kindly to you refusing an full offer of your claim.

You could carry on to court and say that you hadn't received the offer in your timescale however I'm sure the bank will have your telephone conversation recorded and would use this in their defence.

Please read the post about Interest in the Reclaim Help Thread which is linked in my signature.

The bank will expect to pay any monies due into any accounts that are in a debt situation with them.

As you have submitted your claim through MCOL before receiving this offer you can still accept the offer but you need to add in any court fees you have paid and the interest you would be due. Don't cancel it on MCOL as yet but go back to the bank and say thank you'll accept with the addition of the interest and the court fees.

I wouldn't bank on getting an acknowledgement letter I sent my first letter on 19th February and the second on 6th March and have still not had anything from them at all. I did call them on Monday and they said that an offer letter for my full claim minus interest will be sent out by the end of the month, not sure I believe them, why if they know that they are going to offer an amount it can take another 2 weeks to post a letter is beyond me so I started MCOL on Monday my husband is going to wait a while and see if a letter turns up for his account.
    I'll keep you all posted!
