    Bizzare!

It appears to be a stall tactic aimed at consumers "losing interest" in their claims (a lot of my friends have been asked the same thing).

At the end of the day, any complaints department worth their salt has a computer system that will, at least, allow them to sort the charges on any given account. NatWest must already know EXACTLY how much they have charged me over the past 6 years!!!

btw: also worth noting when dealing with the 127 reference number. I have found out this morning that absolutely nothing has been logged against my reference!

Hope they don't ask me to do this, it does seem like yet another delay tactic!!

All my letters have been ignored, so sent the step 4 letter off today....the charges are only for £172 odd, hoping the smaller amounts get paid quicker...probably wishful thinking

Thanks Edinburghlass - so just to confirm I don't need to send anything to the bank initially, just if they file a defence? Sorry first time I have done this..!

No you don't need to send anything to the bank until/unless they ask for it as you have now told them you are going to court with your claim.

I sent the first letter asking for my charges back and natwest sent a letter back with statements saying to highlight all charges and send back with covering letter etc etc.

I have gotten everything together with my covering LBA. Natwest have given me a freepost address to reply to, but i'm not sure whether to trust it or not. Should i just send it recorded to be safe?

you can still send it recorded, just take the freepost bit out

I got my statements back on Friday, just a bundle of 6 years worth in a torn bag with post office tape all over it, no letter or anything though. I have today sent the second letter to my local branch recorded delivery so will wait and see i guess.

Question - the original overdraft they got you to pay off with a loan - what proportion of that would have been made up of unlawful bank charges ?

And don't forget you can reclaim charges incurred on the loan too - late payment charges etc.

You are claiming to get in the position you would have been in had they not taken the charges...so if you can show it forced you to get the loan...then you should be able to get at least the interest paid on the loan back.

    hi
well i rang bank today to get details of loan a/c and they offered to send me statements and loan agreement so i guess i have to wait till i get them to see what my position is.
another thing id like to ask is i asked on the phone for an update as the 14 days had passed since my 1st letter claiming back charges but they said they have nothing logged on their system. i have the recorded delivery sig that i got from track and trace so should i post first letter again or proceed with 2nd
    many thanks for your help

Not sure if anyone else has found this but Natwest say that although some offer letters may have been sent out in the last few weeks..they now have some magical spreadsheet that tells them if someone has started court proceedings. If court proceedings have started then even though you have had an offer letter and may have accepted....they will not pay up!

It has to be dealt with by the bank litigations department and of course there is no way to contact them other than write to them!

I had an offer letter and sent it back, phoned loads over the following 2 weeks to be told to be patient and the money will be paid in then I called last week and they now are not paying.....anyone would think that they do not want to settle before court!
