Hi,
Just called Natwest to see if they are willing to make an offer before I start court proceedings as I have sent 2 letters without any response at all. To my surprise they have told me that they are sending out an offer letter by the end of the month and that it will be for the full amount minus interest, I would of course accept this but do I believe them as I have not received anything from them so far, is this a delaying tactic? Should I file with the court?
Any help would be appreciated. Thanks0 -
Hi,
I received an offer of the full amount i was claiming from natwest about 3 days after they'd been served. I accepted and returned the offer, but not yet heard anything back.
This morning I now get a letter from MCOL sxaying that they are defending the full amount, filed on the 14th day - over a week after I accpeted their offer.
Can they do this? ie make an offer then renege on it and decide to defend? Or is it just a case of departments not talking to one another?!?
Cheers0 -
probably depts not communicating. Was the letter with the offer on date after you filed you court claim ? and did the offer include your court fees and interest ? Regardless carry on with your claim until you receive a settlement. maybe a letter would be in order reminding them the interest will continue to acrue until you receive the cheque.LegalBeagles0

Only you can decide that but as you say...is this a delaying tactic?
If you file a court claim now which you have warned them you will, you will also get back the interest as well. Up to you if you want to wait.
Good luck0 -
you havent received a letter - however natwest do usually pay up on second letter....so I'd be inclined to write to them saying that you would accept an offer less interest at this stage but yyou must have the cheque / payment into your a/c within 7 days (give date) or you WILL file a court claim and you will not accept any offer that doesnt include the stat interest and court fees.LegalBeagles0

Hiya everyone,
really hope one of you can help as am just about to file my claim online against natwest and want to make sure I do it all right!
I'm claiming for over £2k - they have offered £670 and £1224, both offers I have refused.
firstly - I am claiming for a total amount from 2 accounts with them, do I HAVE to do a separate claim for each one - up til now Natwest have been dealing with this as one complaint..
Secondly - when I added up the charges on the statements I did not minus the rare refunds they have given me over the years - do I have to minus these from the amount I'm claiming at court?
Thirdly - when I called to decline the second offer, they said if I was going to take it to court I needed to send all the paperwork to an address in London, is this true? have not heard of this before, thought I just filed it online..
I'm tempted to call them and ask but don't want it to look like I'm not sure what I'm doing!!
Thank you!!

1. One claim for both accounts so long as thye in same name/address
2. Yes you need to enter them in your schedule as refunds and amend the interest accordingly.
3. They are talking about service of documents - and yes you need to use the registered office address for service.LegalBeagles0 -
Hi, Im just about to draft my 1st letter claiming back my bank charges & take it to the bank by hand. Before I do, am I entitled to ask for the charges in the form of a cheque? If so, how would I amend the wording in the letter?. This is my 1st posting on here so please be gentle with me! Thanks in advance.0

hia Esmerellda - thanks for that.
What is service of documents?? Do i send what I have (copies of letters I have sent, list of charges with interest) on the same day that I file it online?

Hi
I have just phoned Natwest after posting my initial letter almost 14 days ago. I was ringing about another charge they have just put on my account for a cheque that just put me £2.20 overdrawn and on the same day I put the £2.20 in to make up the amount. I now see they paid the cheque but charged me £35 for the privilege. I phoned asking them for it back (politely) but was told that because I had written a letter reclaiming my bank charges and a 'goodwill payment' has been made (has it, I asked? - the letter is 'in the post' was the reply) they refused to refund my £35.
I hope they are not going to make this excuse forever! I did however tell the 'quite abrupt' woman on the phone that I would add it to my claim - can I?0
