  • I think the NatWest have lost the plot. I claimed back £1171 which was paid into my account at the end of last month. On Saturday I received another letter offering me £1171 as a gesture of goodwill!!
    We finally did it! Debt free 28/6/10 :T :beer: :T :beer:

    Thanks everyone for your encouragement - yes, I will go after those bank charges, and yes, it is worth the effort! I think I was feeling Monday morningish when I posted!
    I opened up an account with Yorkshire Bank today so that I've got it ready incase Nastywest play mean over retaining my account. Should receive my Maestro card within 5 days. I was very impressed with Yorkshire Bank - seems a much more personal and friendly service altogether.

    I've been doing some major reading up on this thread re CPR Part 18 and also the Consumer Action Group website and copied the following from CAG - Martin3030 dated 4th October 2006

    I hope I don't get into for copying and pasting the information.


    At the defence stage it appears that the NatWest solicitors are asking claimants to complete a Cpr part 18.
    They claim they have insufficient POC and request the claimant to send this to them.There is no requirement to do this and the letter below can be sent in response.
    Dear Sir or Madam:
    Claim No:

    I Acknowledge the receipt of the defence posted on behalf of National Westminster Bank plc.
    I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative
    Furthermore I consider that the CPR part 18 request is intimidatory and I intend to bring the intimidation to the notice of the court. However, for clarity, I confirm the charges I am claiming were applied to the following account:
    Account Name:
    Account number:
    Sort Code:

    Please also find enclosed a breakdown of all charges I am claiming.

    blimey Natwest are taking time to pay money into accounts:mad: ...I sent my letter back accepting their offer as a partial payment and have been told that it could be 7 - 14 working days!!

    arrgghhh soo impatient!!

  • Hi All.

    Long time reader first time poster :D

    Inspired by all of you guys and friends who had actually done it I took the plunge and am taking on the banks. Barclays paid up straight away (Woo Hoo), Capital One has gone to court but Natwest I need help on.

    I sent off the letters as normal and added interest to each using Martins Handy Calculator. The total was £1855.23. Natwest have replied offering to pay £1795.23 into my Natwest bank account.

    I no longer have a NatWest account. After talking to the Consumer Credit Counselling Service (which I recommend to anyone) I have a £6500 NW shaped debt that I am paying off at £1 per month. Presumably NatWest want to reduce the debt I owe them. I have a number of Priority Debts and also arrears on these debts which include rent, council tax, fuel bills, etc. which I believe need to be paid off first so as not leave me homeless or in prison. I rang NatWest and they said it was not their policy to issue a cheque and they were happy for me to take them to court.

    Has anyone come up against this before? Can I reject their offer and ask for this amount as a cheque? What happens if I then take them to court? Will NatWest say, “Well we tried to pay him this money but he refused.”

    After a bit of a wobbly morning when I thought I might forget about claiming my charges back, I've now committed to DOING IT.
    I've done my letter ready to post by registered mail tomorrow, together with a natty little spreadsheet which details my claim for £1184.62 - date, the charge details, amount and interest.

    I'll keep you posted!

    Hi

    Just to give a brief outline i sent off letter to reclaim charges of 1700 10 days ago...rang the customer relations dept to check on claim and was told an offer letter had been sent out...when this didnt arrive i rang my telephone banking (as i was sick of being on hold whilst trying to ring the customer relations number) and was informed that the offer ammount was for 1125.

    I have seen several threads stating that people have rung to reject the initial offers and on doing so have been offered a revised ammount.
    So i rang customer relations today...after being on hold for 40 mins and finally getting through i stated that i had been made an offer but it wasnt an ammount i was willing to settle at and was just told to "send offer letter back with covering letter as to why you dont accept" she didnt even ask for any of my details or what the initial offer was/how much i would be willing to accept etc...

    I just wondered if anyone else had been in a similar position?! i am supposed to be sending the second letter in on Wed but obv would prefer to come to some sort of agreement prior to having to do that!

    Well, today i started my second online claim. I've already filed against Alliance and Leicester and today was the turn of the Natwest. I'm still encouraged by the people that say they haven't got to the court stage before being offered a refund, but if not, i'm prepared to go all the way to court. I bet they won't even turn up to defend themselves!! :mad:
