This last year i fell ill and couldn't work and like everyone else the accumulated bank charges snowballed to £1429.00, i wrote to my bank and insisted they pay the money owed with interest calculated at the current county court standard rate some £190.00. Since the first letter the charges have grown to £1523.00 from others i have found and charges applied since the first letter. The bank offered me the £1429 asking me to sign a statement to wave my rights to reclaim any further charges. As you will have guessed i have declined and and demanded that they repay the revised amount plus the interest but this time i gave them an option to meet me half way on the interest which i think is fair after all they charged me interest on the overdraft their charges created. Three weeks have passed as of last week when i filled in the Money Claim on line proceedings. I expect they will say they are going to submit a defence granting them a further 28 days. I think it will be very unlikely that they will indeed submit a defence as they will have to disclose how these charges and procedures are made up. If they do it will be a first and i will make sure every TV and Radio station are there to here the outcome.
Be strong and brave and get your money back it is yours after all and screw them for the interest too if they have caused you to go into the red with their charges.......
If anyone wants any spreadsheets on how to calculate compound interest for the county court let me know

I managed to get 140 pounds paid back into my account today by teh lending department in Brighton. Took alot of persuading, tears and begging for them to just give me the money back. I cannot believe how they can justify 76 pounds of charges for a 99p dd error and not think they can refund the amount.
We have decided once the charges are in the account we will look for a new bank, Natwest really are a nightmare however we do admit some of it is our fault!

I also give this site its due for providing me with the letters necessary and help through the forums with ppls experience to do what i did. I just hope i am successful for everyone's sake0

I got a real buzz posting that letter and spreadsheet today. I sent it recorded (ie signed for) delivery, so let them just start saying they never got my letter - I'll print out the proof it was received from the Post Office 'track and trace' website :rotfl:
I am DETERMINED not to be brow beaten by them - and I'll go to court if they decide to play dirty. I'm remembering the stress they put me through during a period of a few months, some years ago. I enjoyed sending them a snotty (polite, yes... but snotty) letter ha ha

Grrrr they make you so mad.....if it was the other way around they would be threatening legal action by now.
Hiya finally after spending a long time on the phone and threatening to contact the banking ombudsman WE GOT OUR MONEY :T . Our branch kept us waiting another half an hour after first telling us we would have to wait 10 more days for them to even start to think about sending us a check , my husband was fuming . I have me/cfs and it has taken its toll on me today . At least we have our cash and we owe the fatwest nothing at all now , but they are going to close our account now . We might still contact the banking ombudsman about that but with mt health we need to wiegh up if it will be worth it .

This really is bully tactics, in my opinion, saying that they are going to close your account. We should not be penalised for taking the bank to task about unlawful charges. Read The Daily Telegraph (3rd March 07) article - seems that the Financial Ombudsman Service will take issue with these banks and force them to pay compensation.
Do not be bullied by the banks - tell the FOS what Natwest are threatening, and they will sort them out

arrrgghhh still no sign of the money in my account! I will be on the phone again tomorrow and asking them to process it there and then! I wonder if mine is taking longer because I accepted the payment but only as a part payment for the full amount they owe me??

Oh its sooo frustrating, isn't it! They dragged out even sending my statements (altho' they did send them within the 40 days). Stick to your guns - they will pay up. Don't let them intimidate you!
