Hiya, depends on how much they are for whether they will be beneficial to do as one claim or 2 separate claims. I also have 2 accounts with Natwest but total charges I was claiming came to less than £5k and therefore I did as a joint claim to ensure it went through Small claims track.0 -

This post is for your information only. Please remember to send Subject Access Requests to Goggarburn or Bishopsgate because the branch will simply forward it on. Any letters which are for charges and including spreedsheets should NOT BE sent to the Branch but to Customer Relations Unit, 225 Shenley Road, Borehamwood, Herts. Any correspondence to the branch will merely be forwarded onwards and any enquiries via the branch will similarly be advised to deal with Customer Relations Unit Borehamwood. The likely delay in getting to the right people, if correspondence is sent to the branch, can vary from 48hours to 5 days depending on how each branch deals with mail. As I said this is for information only and has been the case since late December last year.0

Hi all, I am reposting this again as time is running out!!!
I desperately need help, I was going to save posting a thread until I could let you all know my success story of claiming back £3777.00, as was going well but now hit a serious brick wall. I am at the stage at waiting for a court date, but have a big problem, the court has now sent me an Order of Judgement telling me I have to respond to Cobbetts 'Request for Information' or they will strike out my case! Even though I sent the court a letter asking forr standard disclosure and about intimidation, I have sent it all, and now I get this, I havent heard this happening to anyone and am now quite scared!! Can anyone give me the answers to the following questions that the court need from me, its all Jargon and I have not got a clue!
2.2 In relation to each charge, please clarify the following: a) is it the case of the Claimant the same should not have been chardwed?if yes; please explain why the claimaint contends that the same should not have been charged? C) if no; is it the case of the claimant that the same should not have been charge in this amount? D) if yes; please explain why the claimant contends that the same should not have been charged in this amount and identify the sum the claimant contends should have been charged. E) if no; please state the claimants case.
3. In your claim you state that ‘the charges are an unlawful extravagant penalty’
4. Please provide the following particulars in support of your claim:
4.1 Please specificy the clause(s) pursuant to which the charges were applied;
4.2 Please specificy whether the chares applied were due to a breach of contract by the claimant;
4.3 Please identify in each case the particular breach of contract (by reference to appropriate terms of the contract) that the charge was related to.
5. In your claim you state that the charges are ‘an unfair penalty under the unfair terms in consumer contracts regulations 1999’.
6. Please specifiy all of the facts relied on by the claimaint in support of the contentions in parapgraph 5 abopve, and in particular please identify the contractual provision(s) that the claimaint alleges are invalid by reference to the regulations.

Received Cobbetts AQ today. In the Other Information box they wrote: "Case management directions cannot be proposed until the claimant serves a reply to the Request for Further Information which was due on 2 March 2007. In light of this, the defendant may amend its defence or apply to strike out"
I followed the advice many many posts ago which said that the request for further information could be ignored as it did not apply to the small claims track.
Is this their attempt to intimidate or have I followed bad advice on this thread?
I can't afford to lose the £220 court fees
a word of warning to anyone still thinking of reclaiming - ITS NOT EASY, its very stressful and looks like its going to be an expensive mistake0 -

The information is regarding the CPR Par 18 which i have to reply to by 23rd of march or they will strike out my claim
the are asking me to provide the following particulars to support my claim
In relation to each charge please identify (a) the date when the charge was charged (b) the amount of the same and (c) the reason given for the charging of the same.
In reelation to each charge please clarify the following (a) is it the case of the claimant the same should not have been charged (b) if yes please explain why the claimant contends that the same should not have been charged? Sorry to appear to be so cynical, but I'm wondering why a Natwest staff member is posting on these boards. I have a good friend who works for another high street bank, and he tells me that staff are banned from participating in public discussion boards and commenting on bank policy, or face disciplinary action if caught.
Just curious.

I hope someone can advise you. I must say, all this is putting me off reclaiming my charges. I don't understand why the banks don't set, and stick to a policy on refunding charges. Why are some people refunded without any hassle, and others are subjected to all the legal stuff?

Well, I finally prised the last of the statements out of Natwest, so HOORAY, I can start my claim with them. Its taken a while and a few phone calls to get the statements out of them!
