    Firstly, thanks to this site (stumbled upon by accident), for giving me the info to start a claim for unfair bank charges.

    Briefly, I used the set letters and was made an offer by the Natwest bank (about half the amount I claimed). I rejected this and made a claim through the online moneyclaim site.

    I obviously wasn't as thorough as I should have been regarding the particulars of my case and when I went back to the site it just said I couldn't take any more action online. This morning I received the defence! It's pretty long-winded but I understand it (I think!). From the original set letter, they've highlighted the phrase 'unlawful at Common Law Statute and recent Consumer regulations', and asked I specify the facts I'm relying on with regards to the above. First question: Where can I get this info? ie. the actual paragraphs from law that relate.

    Second question: now it's out of the small internet claims court and at the 'big' one, am I liable for court fees or have I still the possibility to strike the claim? I'm thinking I give them the info they want but if they still come back with a defence I might have to leave it as there's no way I can risk court fees.

    Has anyone else experienced this particular defence?

    Hi, I understand how it feels for you, I had the exact same defence from Nat West. I too was panicking, and even tried to get a solicitor to help me out, but when she looked at what I had done myself she was impressed and told me to go for it and I could do it. I replied to it and sent in the court allocation questionaire.Two weeks ago I received court date for May 24th. Then today by special delivery I received a letter containing a cheque for the full settlement. I would be happy to send you a copy of the reply I sent to them if it will help make it easier for you, as I know how stressed I was in case I left a loophole for them to use, but obviously it worked fine.     As its only a date that is wrong and not the amount they are unlikely to challenge that. As they have lodged a defense you may get an AQ to fill in and there is a guide to that in the Reclaim Help Thread, link in my signature.

    Update - only received letter from Borehamwood saying they were looking into it but with no date by which time they would respond. The 14 days were up last Monday so yesterday I sent them a Letter Before Action but included a revised list of charges. It amounted to over £7.5k WITHOUT any interest (WITH interest would be almost £9k!!!.) Can I claim for this via MCOL and which court will it be held in. Do I need to get legal advice due to the amount being over £5k? :confused: Please help.

    After hesitating for a while about reclaiming charges, I've decided to go for it tomorrow. One doubt though: Which address to send the letter(s) to?

    I looked at the several threads but couldn't locate it. Perhaps a sticky could be generated with the suitable addresses for all the different banks?

    Anyway, in NatWest's case, I noticed Borehamwood mentioned a few times. Looking at its website I came across this address:

  • Am just starting on the path of reclaiming bank charges. Asking for £13, 958.00 from Natwest. Have sent 1st template letter and awaiting response, will keep you up to date with progress.This site has given me courage to take it further if necessary. Thanks.

    I looked throught the Natwest thread but couldnt find an answer to this (if I missed it, sorry)

    but I have 2 accounts with Natwest, and am looking to claim charges back for both - if it does get to the court stage, will I need to file 2 claims with MCOL or put them both together?

    Any help much appreciated

    Just been paid out full £520 charges from Natwest , about six weeks start to payout, talked to work colleagues and directed them to MSE and one has just been offered £2400 from (i think) Halifax, which he's going to accept, keep at 'em everyone

    I've been battling with Natwest for about 2 months now to get my charges refunded. Yesterday their lawyers sent me their Defence, which has clauses like "The Claimant is put to strict proof of each and every charge the subject of the claim and must identify in respect of each charge ."... However another document came with the defence called a "Request for Further Information and Clarification"

    It says I must respond by the 23rd of March, otherwise the defendant will seek to strike out the claims.

    The Request
    1. In your claim you state: "The Defendant applied numerous default charges to the Claimant's bank account".

    Please provide...
    In relation to each charge. The date, amount and reasons given for charges.

    Obviously I did this in my first letters. I have all those details already. The bank responded and recognised my initial letters. Yet now they can ask for clarification on this??

    3. "In your claim you state that "the charges are an unlawful, exravagant pentalty".

    Please provide the following.
    Please specify the clause(s) pursuant to whch the charges were applied
    Please specify whether the charges applied were due to a breach of contract by the claimant.
    Please identify in each case the particular breach of contract.

    4. In your claim you state that the charges are: "contrary to the Unfair Terms in Consumer Contracts Regulations 1999".
    Please specify all of the facts relied on by the claimant in support of the contentions in paragraph 5 aboved. and in particular please identify the contractual provisions that the claimant alleges are invalid by reference to the regulations.


    ANYWAY
    Sorry to be so long winded. But it doesnt make all that much sense to me. Any advise would be a great help at this point..
