hi
A couple of weeks ago I wrote to natwest with the 1st letter posted on this site and today I received a letter back stating that
" I am sorry to learn of your displeasure but we believe that our charges are fair, reasonable and transparent. We are satisfied that our charges are applied in accordance with your agreement with us and our published tariff and comply with applicable laws and regulations."
Now what ?????
Is this good or bad ?????
Will I get anywhere ??????0 -

I cannot accept your offer of £98 as a full and final settlement for this claim. I will accept this only as a part payment and without prejudice, but I will continue my claim for the rest of the charges.
Hmm, that just makes the letter look quite.... repetative?
Does this sound ok?:)I refer to default charges applied to my account amounting to £1960.90, which I have requested you pay back

I wrote to you on 03/12/06, making the original request for a payment in settlement of my claim. As I have not received a satisfactory response I am writing to inform you that should the response to this letter not be acceptable I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the small claims court.
This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the small claims court will rule in my favour.
I have attached a full schedule of the charges and interest with this document.
I look forward for a full response to this letter within 7 days; otherwise I will commence court proceedings to reclaim my money.
That flows a little better? I'd appreciate it if you wouldn't mind having a quick read through that!
Many thanks0 -

Yes, that's better. I use a different template for the claims I'm doing for people, and forgot that Martins was different. My suggestion fits in well as the first paragraph on the templates I've got. It fits better as the second on this template.
The only parts I would change are............

Change this to county court. Small claims is only a court procedure that this claim will be dealt with. It is not the actual court.

Change this to the name of your local county court. See THIS THREAD (post number 6) to find your local county court. How many surrealists does it take to change a lightbulb?

Hi,
Firstly I am sorry if this thread is a duplicate or my questions are answered in previous threads. I have looked but cant find a definite answer.
I have a Nat West current account with a £1000 overdraft, I also have a Nat West credit card with a balance of £2500. Most worryingly we have our mortgage of £160000 with Nat West.
I want to claim back my charges on my current account only. Is anyone able to inform me IF the bank decided to close my account due to me claiming charges back would this apply to only my current account or also my credit card and mortgage account.
Obviously if there was a chance of my mortgage account being closed there is no way I could therefore claim my charges back. Far too risky as I am sure I would really struggle to remortgage the full amount.
I want to claim my charges back as I think it would be a fair old whack but certainly dont want to risk our house over it.
Anyone please? What if the hokey cokey is really whats its all about?0 -

should i wait?
should i call them?
should i send another letter?

It's not uncommon to receive your statements in different batches. If you are still in the 40 days time limit, you just have to sit and wait. Only complain/do something if you don't receive all your statements within 40 days. How many surrealists does it take to change a lightbulb?

It says that you can reclaim 6 years of charges from your bank, i have only been with my bank (NATWEST) for about 3 years. Do i stand a chance in reclaiming my charges made against me?
