  • No no I totally understand your frustration. In a selfish way I'm just kind of glad all this happened to me so early so it's not too late to fix things. I'm not too bad now and I've managed to sort it all out before it got too big.

    Right Natwest made me an offer which I refused and I sent the template letter threating court in 14 days, now the manager is phoning me and I dont know what to do. He's left messages but I haven't answered mainly cause these guys can talk there way out of anything, where as I am usless at this type of thing and he'd end up talking me out of it. What should I do???

    Speak to him. Explain that you will not negotiate anything over the phone, only in writing, and if he wants to revise the banks offer to send you another letter with the offer in. Tell him you will only respond to written offers.

    It's quite important to keep records of all your dealings with the bank regarding reclaiming your charges. If you issue a court claim, you can't prove in court what has been said over the phone, but you can prove all your written negotiations.

  • I have rejected an offer from Cobbetts and informed them that I have returned my AQ to court (maybe shouldn't have told them!!) they returned a reply with a copy of their AQ almost immediately. Noting on their's but ticks - no extra info in the relevant section.

    I need to amend my claim (I think - nless you feel it's best left alone) my figures in the original are incorrect. Cobbetts indicated this in their offer. My claim was for £2179 and should have been for £1501 (or so they say). I am having a problem with the spreadsheet. Have managed to get one up on the computer, but there are so many. Contractual? Compounded? and others. Is it best that I just try to do 'charges' and the 8% sec.69 or is it best to use another one. Is there one that is 'mostly' used?

    Many thanks for yor help - am so close - don't want to spoil it now - getting very worried and frustrated.

    I'm a bit confused. In previous posts, you said your claim was first for £1501.00, then you posted that you've claimed for £2179.00+interest which came to £2930.00.

    It seems like you've got in a right tizzy with your figures. You need to put this right for the court claim, or you will possibly damage your case.

    Keep things easy. Use the simple spreadsheet over at https://www.consumeractiongroup.co.uk Download this, and enter ONLY your charges. This will work out the total charges plus interest due on these (@ 8%PA). Once you've done this, send a copy off to court with a cover letter saying these are your revised and correct figures. Send another copy to Cobbetts. Do this ASAP.

    My original claim was for 1501 charges plus interest from statements of 677 - I now know that this interest which was debit interest should not have been added in. This made my claim 2179.

    On claim form I indicated 8% to date =£751 + daily rate.

    I know that I should have only claimed for 1501 'charges' only. Then I should have worked out 8% on this figure only -statements(2002 - 2006)517.00 making total claim £2018.

    I got very confused as to what interest could be charged as I was in overdraft most of the 4 years and I thought this interest could be included.

    No, you MUST inform the court straight away of the change in figures. If you send the revised figures only to Cobbetts, and keep the court amount the same. You are making things look bad for yourself. Send two letters off at the same time (to Cobbetts, and the court). Now that you are going to sort out this confusion (caused by yourself), don't add to it by not keeping the court informed of the situation.

    So I received a letter today offering me £98 haha!

    I think they missed the 1 before the 9 and the 0 after the 8.

    I was thinking of saying something like "I would be willing to accept £1508 in the form of the immediate payment of my outstanding natwest loan at £1008 and a payment of £500 into my account".

    Or should I just send the standard letter?

    Send the next standard letter, and add this as your first paragraph..............

    I cannot accept your offer of £98 as a full and final settlement for this claim. I will accept this only as a part payment and without prejudice, but I will continue my claim for the rest of the charges.
