    Hi all,

Thought i'd update you on latest developments and add a note of caution when dealing with moneyclaim.

    Yesterday I posted;

'Just thought i'd amuse you with my current state of play.

Sent all the appropriate letters etc in late jan to reclaim £380. After I'd recieved no response for 4 weeks I filed with moneyclaim. On the same day the claim was served, I recieved a letter from Natwest offering the full £380, dated 2 weeks before-hand. Naturally my blood boiled.

I called moneyclaim and was told that I couldn't withdraw now as proceedings were underway, so wrote back to Natwest explaining what had happened, asking why a later dated 2 weeks earlier had taken so long to arrive, and get this, why they had also sent me SOMEBODY else's offer letter, complete with their bank details to me, a complete stranger, in the same envelope!

Needless to say, the only response i've had is from moneyclaim - an aknowledgment of service in which they say they are entering a full defence.

    Marvellous.'

Well today I have recieved an offer letter from Halifax for the charges I was claiming from them, plus interest. The only thing they wouldnt pay was my costs (£80).

I called moneyclaim, (as I did after recieving Natwests offer letter detailed above) and was told to accept the offer, but keep the claim open until i receive the money, then either close the claim or hold out for the fees.

Last week, in the same circumstances, I was told by moneyclaim that the case couldn't be closed or withdrawn, so I basically wrote to Natwest telling them I was declining their offer, and am now faced with a long protracted affair as they are defending the whole claim.

Just bear in mind that depending on the individual you are speaking to at moneyclaim, the advice is very different! Others in the same situation should bear this in mind when dealing with them. I know my own ignorance of the ins-and-outs is ultimately to blame, but i'm not a solicitor!

    Cheers

I've had a few claims with moneyclaim and on a few occasions I have received full offers from the banks after I had filed my claim. I have always contacted MCOL by email and on all occasions I have been told that once the money from the bank has cleared in my account to let them know and they will cancel the claim

  • Hi
I sent a letter to natwest with my claim amount of £1750 in january.
They told me my offer would be sent out 26/02 but no offer letter came just one saying they would send out statements. I keep ringing but i just get "someone will call you with in 24hrs" Which they dont. Bt since then i have added up the charges again to find they owe me £2550(i wasnt counting unarranged overdraft fee's)
So i rang them again and they gave me a fax number to fax the new information to. I have no idea if they got the fax or if they are doing anything with it. Anyone else having trouble getting borehamwood to answer or call back. I am waiting for "emelda" to call as they say no one else can access the database???

Absolutely I am having the same problem with getting an offer letter and emelda is the only one that can access the database.

I don't know what to do either

  • I tried the number and they were helpful but they said they couldnt deal with it. I told them about borehamwood and they said it all sounded strange!
That only one person can look at the database.

I just want to know if they have the revised claim.

I know i am near the 8 week time frame they have from OFT
But will a revised claim mean i have to start again at week one?
