Hi all,
Just thought i'd amuse you with my caurrent state of play.
Sent all the appropriate letters etc in late jan to reclaim £380. After I'd recieved no response for 4 weeks I filed with moneyclaim. On the same day the claim was served, I recieved a letter from Natwest offering the full £380, dated 2 weeks before-hand. Naturally my blood boiled.
I called moneyclaim and was told that I couldn't withdraw now as proceedings were underway, so wrote back to Natwest explaining what had happened, asking why a later dated 2 weeks earlier had taken so long to arrive, and get this, why they had also sent me SOMEBODY else's offer letter, complete with their bank details to me, a complete stranger, in the same envelope!
Needless to say, the only response i've had is from moneyclaim - an aknowledgment of service in which they say they are entering a full defence.
Marvellous.

Sounds about right for them , they did the same to me so its all the way now no matter what. :T0

Just read your article on receiving someone's else details !! Outrageous, hope they are not mine or I shall be seeking compensation for breach of Data Protection Act!!
What are they doing..................Claiming the following:
Natwest : 2177.00 (Settled for 2127.00, paid today 14.3.07:beer:
Cap One: (me) 853.00 paid: 1059.05 20.04.07 :beer:
Cap One: (hubby) claimed 718.18 13.04.07
Halifax: 1836.00 plus int 283.82 int claimed 30.03.07
Ikea : 324.00 plus 38.70 int (paid 340.00 20.03.07!!):beer:
GE Money: 114.00 claimed 15.03.07 Settled for 90 :beer: :beer:Black Horse: 24.00 (ltr of request sent 15.03.07

I got sent my last six years statements in two sets, one for period dec 2000 - sep 2002 , which charges were 1289, interest 504.08 ANd sep 2002 - Jan 2007, which charges were 1885, interest 621.82 .
They never acknowledged sep 2002 - Jan 2007 So that has gone to court, which has been acknowledged and 19th March a court date should be set.
However, they have now wrote and offered me the charges back on the 2nd claim......But no offer to go with for the first? is it cause it too late for them now it gone to court???? are they tryiing to get me to take one lot of money instead of full amount?

Quick bit of help needed!
Cobbetts have issued me with a request for further information, due by the 13the 13th March 2007.
I read somewhere that it is best to write a letter and explain that i have already supplied this information and should send copies with this response, am i required to go into more detail, i.e specify what each charge was for?
i am tempted to send them my statements and have them work it out!!!!

I too have received a letter of defence from cobbets today and i haven't a clue what its going on about. I have 14 days to respond to the sevice of the defence or they will be applying for an order striking out the particulars of claim???????
What do i have to do as all the 5 points of the defence is in legal jargon which i don't understand.

Why do some people get a reasonable quick settlement and some of you are having to jump through hoops?
Is it because you are with a DPA and Cobbetts are being difficult?
I don't understand how each case can be so different but the outcome is nearly always that we win?
Surely Martin something can be done about this can't it??

You should already have the lists/spreadsheet including descriptions, dates etc of your claim as this forms your defence so just send them off a copy of this.0
