Don't worry too much. A lot of banks are making you issue court papers. Many are even issuing a defence, but they are still settling before you get to the stage that you have to appear in court. It's like a delaying tactic, and I also guess that they hope that some people will be too daunted to carry on.
There is only one case I've read about where they went into court (the claimant had a weak case by not preparing properly). This is out of many many thousands of cases.
If you follow the advice in Martins article. You should be OK. You can come to the forum anytime for further advice or a confidence boost. Many 1000s of others are in the same situation as you, or have already gone through the process.

Hi I sent off my initial letter to HSBC a couple of weeks ago and a week later recieved a letter saying that they would send out 6 years worth of statements in batches and that they will be with me shortly. They also returned my £10 cheque RE: the data protection act.
A week later, still nothing has arrived and it seems to me they are trying to delay me as much as possible. Has anyone had a similar letter? How long should I wait before writing again? How many "batches" are we talking, could I be waiting for weeks/months?
If anyone has any information, it would be much apreciated.

I've moved your post over to the HSBC thread. You may get better answers here concerning your bank.
It's not uncommon to receive the statements in batches. They must still send you all the statements within the 40 day deadline though. If you still have any outstanding after the 40 days, come back here, and I will point you to a template letter you can send out.How many surrealists does it take to change a lightbulb?

I hope I don't get as far as court, but from what i have seen... you never can tell whats going to happen... everyones stories vary. With any luck I will be one of the fortunate ones that gets my money with minimum hassle!!!!

I have just gone through the rather scary and anger inducing list of charges for the last 6 years from Abbey, and I want to send the claim form off as soon as possible, but I want to claim for the right things. I have 2 sets of questions:
1) What address and to whom do I address the first claim letter for the best response?
2) Which of the following can I claim for:
a) Unauthorised O/D fee - £15-£16.50 each
b) Unpaid D/D fee - £30-£32 each
c) Cleared Transaction fee - £15-£20 each
d) Unpaid cheque charge - £32 a pop
e)A one off transaction charge - £65.25!!!:eek:FD claim WON!!!!
Abbey claim WON!!!!
Overdraft £300 limit

I sent my initial request to HSBC on the 15th and haven't had a response.
I've written out the second letter (the LBA) and this will be posted tomorrow when I can get to a P.O. to get recorded delivery on it.
I have claimed for £1014.00 plus £202.61 in interest - so shocked that I ran my account so badly that I let them get their grubby little paws on it in the first place!
Giving them another 14 days to respond. I will only be writing to my branch as that is a registered address of the institution so that is good enough for me - it should make no odds as I could write to any branch of the company in the same way you can deal with your account matters at any branch.
Hoping that they don't put up too much of a fight and just pay up - would make me a very happy bunny after dragging myself from debt from about 5 years ago - got much better in dealing with money and finances - the worst time for me was 1993 when in one month they took over £180!!
Starting to feel a little nervous that court action may be the only way to get my money back from them, but I will not let that stop me.
As a confidence boost to all Moneysavers going through this process, remember Martin's advice.
IT's YOUR MONEY! - and if the banks do offer less than we have asked for remember that we thought the money was lost forever!

I wrote to Abbey and they claim to only have 14 months of charges details.... i have written a second letter asking them to reconsider to prevent legal action.....any other suggestions?

What interest are you claiming, is it 8% or is it the interest you were charged on top of your charges??
You are entitled to 8% but only if it goes to court, if you are claiming the 8% before court, the banks will try delaying tactics on the premise that they think you don't know what you are doing.
I claimed back from the HSBC all be it £200 less than what i asked for, but at the time i prefered that to having to wait a further 28 days and trying to find the £120 court fee. The money was in my account three days after i sent my letter of acceptance.
Hubby is claiming and was offered £400 less than what he asked for and hes not settling for that. Despite giving them an extra 14 days to refund him in full, they haven't. So Monday just gone, filed his claim at the court adding court cost of £120 plus the 8% interest adding over £500 more for them to pay, nearly £3k, the 28days are up on xmas day.And yes the lady in the avatar is me

I posted the Data Protection Act 1998 Subject Access Request letter to the HSBC Bradford on 17th October via Recorded Delivery. I have checked on the Royal Mail website and have seen that this was received by signature on
19th October - now 42 days ago.
I have received nothing from my request - no acknowledgement, no statements.
