Their Complaints Dept said they considered the issue closed, so naturally I have made a claim through Money Clain OnLine, as looking at previous threads, this seems to be the only way the bank will pay up. Another 12 days left for them to defend the claim so fingers crossed.
To anyone else, don't be afraid of issuing a claim, MCOL is very straightforward. All claims seem to go through Northampton so don't worry if you are not local.
Good luck to all !!0 -

can i also ask, do they pay the refund into your account or can you ask for a cheque as I would quite like to put some aside in my isa? I'll get you debts and your little dog too!!! :mad:And best of luck to all the other debt busters out there!!:beer:0

The refund will more than likely be put in your account provided your account is open.0

After getting no response at all from HSBC on my claim of just over a grand, I have now taken them to the small claims. The claim was filed on the 4th, and today I got a letter back from the small claims poeple, saying HSBC have filed a defence and have 28 days to respond. Now I know Martin says not to worry, but I can't help thinking it's all about to go tits up!
Has this happened to anyone else? What is likely to happen now and is there anything I should be doing at this point (apart from panicing!!)
Thankyou0 -
Have they actually filed a defence or acknowledged the claim? Either way I wouldn't be too worried about it, banks frequently do this and then pay up. In fact there was an article not long ago regarding a judge who's getting fed up of banks filing defences when they have no intention of defending the claim. Have a look round the boards, there are a few people in this situation!"Think for yourselves and allow others the privilege to do so too." Voltaire.0

thanks, but yeah, they have actually filed a defence, although if it is just another delaying tactic then I might still be ok!
cheers0 -
They will have acknowledged the claim but won't respond in the 28 day limit otherwise they will have to release their internal cost details, and they really don't want to do that, believe me0

Well after my 'good will offer' of £250, i started and file court proceedings today..
It's really quite a scarey thing to do isn't it LOL
Much as i'm 99% convinced they will back out... there's always that little 1% in the back of your mind thinking
"what if i'm the first person they drag all the way through the courts"
LOL
Thanks guys .... you're all superstars.0
