  • I took HSBC to the small claims for £2002, they put in a defence and have received a letter from them offering £1300. As I am not accepting this offer can anyone tell me what next

    Hi all

    My total claim was £2020.43 including 422.43 in interest. I received an offer today of £1409.00. :j

    They regard the "interest" (they wrote the word in speech marks in the letter. lol) as "not appropriate".

    I had deducted all previous refunds from my list of charges prior to submission but they list that there are £90 of refunds, from 2001 to 2003, to come off my claim. They believe they "will successfully resist any legal challenge". ;) They make this offer for commercial reasons only (Time management and irrevocable legal costs). :whistle: As a goodwill gesture they will also be adding a further £25 to this amount to pay for the temp overdraft fee I took out last Thursday.

    My question - what do I do. 60% of me is telling me to continue and the remainder is saying accept. Accept. ACCEPT!!!

    Please advise

    A couple of points................

    You are only entitled to the interest once you issue a court claim. This makes your entitled claim £1598

    If there are £90 of refunds to come off this, you are entitled to claim for £1508

    Their offer of £1409 is 93% of what you are entitled to claim at this stage. This is a good first offer, and one worth considering. Even if the £90 didn't come off the total. This offer would still be 88% of the total you are entitled to.

    Hi there! There's light at the end of the tunnel!!

    Bank: HSBC
    Amount Reclaimed: £2800
    Amount they paid: £2400

    The story:
    Requested list of charges December 06. Requested money back (1st template letter) January 22nd 2007. Received the standard 'we're looking into it' response. Sent letter threatening court action 5th February. Offer received 7th February (dated 5th of February). Offer of £2400 which I am accepting!

    Thank you so much everyone for your advice and help!! This is the stamp duty for my new house so I can keep my car and motorbike!!

    (Also 'without prejudice' and no mention of account being closed, although did receive a 'statement' on personal loan which I haven't received before!! "A hint, HSBC?")
    £2.4k received back from HSBC in charges!! Woo! That's MY money, HSBC, thanks!

    Thanks as always for your guidance on this matter. I kind of agree that the offer is very good in relation to this 85% threshold that many people are being offered. What I am annoyed about is that I purposely took the refunds off the claim prior to submitting the list of charges. It seems to me that somebody has simply looked at the total of my charges and looked at any refund on my account and then simply concluded that these need to be taken off my claim.

    BTW is there a “partial Acceptance” letter template as I may want to look at this before I make a final decision.

    I have posted my question earlier but no one has answered me.I took HSBC to small claims for £2002 which includes interest, they have made an offer of £1300 for commercial and as a goodwill gesture which I am not accepting, I have not received my court allocation questionaire yet as they have also entered a defence. In their Letter, they have said that if I am not happy with the offer then I can escalate it to the Senior Manager (service quality team).
    They have also added that they will not accept my including any interest as they do not find it appropriate and therfore their offer does not include any.

    Please advice

    I sent my 2nd letter (from this website) requesting my bank charges plus interest from HSBC. It gave them 14 days to respond, which was up on Mon 5 February. No mail received in the post by then, so I took my letter in to my branch threatening court action.
    I then received a letter from them dated 5 Feb, on 6 Feb, from their Senior Service Quality Officer! This stated that, "I am looking into the matters you have raised and will contact you with a full response as soon as I have completed my investigations."
    The advice I need is: Do I stick to my 7 days before proceeding with court action or do I wait for their response?

    Always stick by your deadlines. You could be waiting months for the bank to "make a decision".

    No question about it Angie - stick to your timescales especially at this stage. You are controlling the situation not them. Believe me its fun :D.

    You've given them a deadline if you don't keep to it what impression do you think they'll get.

    I too received the letter about investigating the situation blah blah blah. As soon as I received it I sent them the 7 day deadline letter. On the 7th day (today) I got an offer. :beer:

    I'm just sorting out the smallest details to my offer (see above) but I strictly kept to the timescales I set them.
