    I suppose if you are unsure (my Sister is) about going to court and the winning/losing gamble then maybe she should just take the £698 even though it it way short. She does not have a great deal of money so the next stage of the process would involve paying the cost of the court claim which again she would like to avoid.

    Do we all agree that an acceptance of the offer would be best in these circumstances?

    I will NOT be giving up so easy with my 2 claims (Abbey and Capital One). I will take them to court but i am only at stage 2 with these.

    Only your sister can decide whether she should accept this offer.

    Until you issue a court claim, you are not entitled to claim for the interest. Taking the amount you can claim (£845.50) and comparing it to the offer (£698). The bank have offered you just over 82% of what you are entitled to. This is not the best offer around, but it's also not the worst (far from it).

    I am in the process of sending the third and final letter :( im scared as I dont want to sort this out in a courtroom.

    My second letter was answered with a generated message, ''sorry to hear about a complaint, please give us a month to access the situation...'' I just thought blah! and sent the third straight away.

    All in all its £679.48 inc interest. Without prejudice Ive asked for £580.15

  • Carry on with the next stage and say that you will accept these refunds in partial payment but will be progessing to court for the full amount.

    I have an account with Hsbc and i have found that i have incured several £25 charges over the last 5 months totaling £575.00.
    I know this is not a great deal but i have always kept my account in the black.
    Anyway i went to see the bank to raise my Overdraft and the bank manager looked at the account and refunded £225.00 worth of charges back into my account straight away but basically said that was all he could do for me.

    I would like to know if it is still possible to get the rest back through writing to them or would they look at the refund i've had and tell me to get on me bike?

    I had 2 accounts with HSBC 1st account they refunded £1700 on last July after letter 2 and it didn't affect the account at all they never closed it or limited the o/draft or anything like that.

    Account 2 is an account which was closed over a year ago and passed to debt collection as is had an overdraft which I didn't pay off, it also had £2000 worth of charges on it which is my 2nd claim.

    After I put 2nd claim in they started getting funny on my open current account refusing payment for the sake of a couple of quid etc. etc. I have now closed the 1st account after having acrued another staggering £750 worth of fees since last July and now they have sent out the man for the cards and cheque book for this account (make sense??!!)

    Anyway now I am contemplating whether or not claim back the £750 or just leave it, there is not much they can do to me now I have an account elsewhere which for 4 months has been running absolutely fine, no charges even if I go £3 or £4 o/drawn for a day which HSBC used to charge me £25 and a card misue fee for (how kind). :j

    If I were you I would go ahead with your claim after all it was them who charged you ridiculous amounts of money for the littlest thing, open an account elsewhere and if they do say they're gonna close your account what you get refunded will clear or pay off some your O/D and you can start afresh elsewhere.

    Whatever they do i.e. close your account or demand back your O/D they have to give you 28 days notice so it won't be instantaneous you will have time to sort yourself out. Good Luck!

    I have typed out my letter to HSBC claiming back the £3600 they have charged me over the last 6 years.

    I have read all the guides and Martin's article but can I just clarify, when I send my first claim letter, can this be to any branch that I can pop into and hand over the counter?

    Or, does it have to be the branch where your account is held ie the one with the matching sort code? :confused:

    My holding branch is within a supermarket but the address on my cheque book is a PO Box in Coventry. Although my closest branch is actually somewhere else (the town where I work).

    Sorry if this is confusing, could really do with your help though, so I can get the letter in and start the ball rolling.

    First letter, asking for statements. I think thats 1.

    Seconds asking for money, 2 and 3 with int.

    Thirds the court threats which are 4, 5 and without prejudice 6.

    You need to send the letter by recorded delivery to the address contained in the 'contact details' sticky at the top of the front page.

  • HSBC said I could have the money I had claimed back last week. Then they wrote to me today and offered me another £700+ on top... I thought that was jolly nice of them but called them just to check. Apparently, they are so swamped that they are messing letters up all over the place... I might ask them if they wanna employ me... ;-)
