Incidentally, I am more than happy to update eveybody of my progress with this. So far so good, it took only a week for hsbc to send me a full set of statements, and they returned my £10 cheque. I think they call this the calm before the storm...0

hello i am at the 3rd letter stage and i am just about to enter a court proceeding against hsbc who have just sent letters back saying no we will not give you a refund and this is our final response in this matter. do you think i am having more trouble than most because this account has now closed. most people seem to be getting their money after 2 letters. any advice.A child smiles 500 times a day, compared to an adult over 25 smiling 15 times a day.0

Hello - I asked for a list of my charges but received my statements (very promptly) from HSBC, and am still in the middle of opening them all and looking for the highlighter pens.
I have checked on the thread which charges I can claim for, and intend attacking the pile over the weekend.
As they've sent me statements rather than a schedule of charges, should I assume that they do not have a record and do not know the amount?
Does anyone know if they actually check the amount you claim is correct?

Yes they will and your list/total should be accurate as this will form your defence if you take the bank to court. They will most certainly have a full record themselves.0

don't suppose anyone can help me with my query a couple of posts up? REALLY want to send off my second letter to claim £800 odd but worried as i still have overdraft in that account... should i get my balance back to zero before i claim in case they close my acc and demand in full or WORSE - refer my outstanding o/d to the debt collectors!0

1) The statutory interest (8%) can only be charged at the court stage. It is nothing to do with bank charges. It is allowed to be added to claims in the county court (s69 County Courts Act).
2) There is always a chance your bank can cancel your overdraft if you reclaim your charges. They are allowed to do this, and some banks are doing this a lot. It's a risk if you have an overdraft not paid off.How many surrealists does it take to change a lightbulb?

yes, i may have been late in one or two payments a year or two ago but overall very good - does that matter that it was once or twice then?!0
