Make sure you have all opened other bank accounts as I claimed with HSBC a few months ago and they have just got round to giving me 28 days notice that they are closing my account with them.0

1. The Claimant has an account ********

the Defendant, opened 16 September 1997 2.
Since
16/02/01 the Defendant debited charges and
interest in respect of purported breaches
of contract. 3. Defendant is aware of all
details as a list of charges has already
been supplied. Another copy will be sent.
4. Claimant contends: (a) The charges
exceed the Defendant's losses caused by the
breaches; (b) The Term permitting the
Defendant to levy such charges is
unenforceable under the Unfair Terms in
Consumer Contracts Regulations 1999, Unfair
Contract Terms Act 1977 and at Common Law.
5. Claimant claims: (a) return of the
amounts debited of £1253.50; (b) Interest
per S.69 County Courts Act 1984 of 8% -
£391.25 continuing at 8% until judgment or
settlement at a daily rate of £0.27; 6.
Alternatively, if the charges are a fee for
a service, then they must be reasonable
under S.15 of the Supply of Goods and
Services Act 1982. 7. Costs allowed by the
Court.
Also in the Amount claimed box should this be the total charges or total charges plus the interest at date of claim issued????????

We were due to issue a warrant of execution tomorrow but checked on the old internet banking and its been credited!!! We won by default as the bank did not enter a defence.
Please do not let the banks fob you off, stand your ground, if they were in the right, with all their money and access to laywers why have they not defended in court?????

In Amount claimed enter the charges+interest (£1644.75). The particulars look fine, although a few people have had a problem using this full version (the site says it is too long). If you have this problem, use this version (it is the same, just cut down a little).........................

Hello!
received a letter back from HSBC yesterday (within their month time scale that they set)
my letter was dated the 1st December an included all charges up till Ocotber this totalled to £885 - thay have offered me £769.00 which is a step in the right direction.
i sent them an adiidtionel letter on 2.2.07 with a revised shcedule od charges (incl nov/dec) this then came to £1100, i'm quite sure i will now inccur a charge for Jan/Feb -
What course of action is now best to take?

I phoned up HSBC service Quality Team - they deciced to reminburse me the nov/dec - i had to hand write this on the acceptance form, then they have cancelled any further charges over the next couple of months.
£1100 in the next 7 days - up yours HSBC! i will have a pint on you!0 -
it's ok, they sent me the cheque yesterday. may i say that hsbc may be a couple days over their promised 7 days...
all sorted now.
