I received a letter from them on 16 January basically saying that they will forward copies of statements for the period in question in seperate batches and that these should be with me shortly. They are doing this FOC and have returned my cheque.
I am concerned that this is a delaying tactic and that the statements will not arrive. Does the 40 days response time refer to just a response/acknowledgment from the bank or is it a deadline of when I should receive the information requested?

Just to let you know these are excatly the same questions and comments I had. I sent my first letter to HSBC Data Protection on 14th dec. Thay did exactly the same thing - sen the cheque back and would slowly send out batches of stateemnts.
By about 13th Jan i was a bit concerend :eek: as the not all the statements had arrived. on 15th jan the last set happened :j (We need to remember they have upto 40 days to submit all the information).
I have sent my first letter reclaiming the charges together with a breakdown of charges and interest (£2100+ :mad: ). I eagerly await their reply around the 30th Jan - (if not I'll just follow the timescales we've all been given).

Bank hsbc: Can anyone confirm if they have been succesful reclaiming fees fromhsbc . I have currently sent the first two letters in the process and have been awaiting a reply, to date they have just informed me they are looking into the matter, (i have now been waiting 5weeks) since i requested they refund my charges, hsbc inform me they have 8 weeks to respond is this correct? does anyone have any advice should i send the 3rd letter or sit tight? many thanks dt220

Just follow the steps set out in Martins article. Move ahead at your timetable, not the banks (ignore their 8 week nonsense). Many many people have been successful against HSBC. Follow the steps in the article, and you will be OK.How many surrealists does it take to change a lightbulb?

In the first letter requesting statements the response time scale is 14 days.
After sending a request for refunding the charges the response time is only 7 days. They will send a letter telling you they are looking into it don't wait proceed to the next step.0 -
Hello all, what a great site, it's good to see people helping each other in this way. I've got my 6 years of statements and have been through them with a highlighter pen but am slightly confused as to exactly which charges I can reclaim.
Total charges?
Card recall charges?
Returned item charges?
Card misuse charges?
Temporary overdraft extension charges?
Standing Order or DD declined charges?
Any other charges?
If someone could clarify for me with a list of exactly which can be reclaimed I'd really appreciate it and it would be useful for others (I've had a quick read through the thread but couldn't find this info, unless of course I'm just being a tad dense!). Thanks in advance.

Hi there,
Could anyone help me please? I wanted to check whether the 40 day limit in which the bank has to respond (to my letter requesting bank charges for the last 6 years) refers to any response ie an acknowledgment or whether it refers to the information requested.
I have received a letter from HSBC saying that they will send me my statements FOC (which is great) in seperate batches shortly but I am anxious that this is a delaying tactic and whether the statements will actually turn up.
