    yes, ou can claim - from 6 years ago from the date of claim. so if you claim today you can get any statements from the last 6 years and claim from them - regardless of whether account is open or not.

    write to them with a letter and £10 cheque requesting ALL of your statements during the last 6 years that'll be from 2001 - 2005.

    OK - I will find the link to the CAG (consumer action group) website thread that gives you all the information you need. You will need to do three bundles - one for the court, one for HSBC and one for you. It will take ages to print off just take your time and do it carefully.

    Just thought I would let you know about a success story.

    My girlfriend was getting in a mess with bank charges, you know what it is like, as soon as you get one it's like a never ending struggle each month just to cover the charge and then you get another charge and another!!

    Anyway, I sent the letter off detailing the charges from the past 6 years on the 4th May. The charges totalled £558 including the interest.

    HSBC replied on the 14th May saying they would investigate and get back to us. Having some some messages on the forums saying that people were wating 8 weeks and getting the charges back we decided to do this.

    I emailed them yesterday (5th July) asking what the latest as we hadn't heard anything and they replied today stating that they had sent a letter out offering the full amount back :-)

    All we have to do is sign the letter and bobs your uncle. Seems it may be worth waiting the 8 weeks, especially if it is a smaller amount than the £1000's that some are claiming.

    Hi, i'm still at the early stage of this process but reading the other replies i'm hoping someone could help. Claiming charges from HSBC and got as far as the second letter (have been through the process of previous statements arriving one-by-one in the post) have calculated the charges and asked for them back. have just received a letter saying they are "looking into the matter" and will contact me when they have completed thier investigations. Has anyone else recieved this reply? if so what do you recommend, do i wait or send letter three? You all seem so helpful out there, just hoping someone could advise on this.
    Another query is do i cliam all charges, even those for interest on an agreed overdraft?

    i could cry, hsbc told me on the 28th that they sent the acceptance letter on the 27th well im still waiting have emailed them a few times and been fobbed off i even asked if i could go into my local branch and sign we have nothing and i really dont want to borrow from the mother in law but looks like we will have to i could scream :( it didnt take this long with my OH and TSB now its the w.end and my OH is on holiday next week we were kinda ho[ing we wouldnt be living skint then too oh well i must learn to be patient!

    Hi, i've been trying to reclaim my bank charges. I sent a letter approximatley 2 months ago, with a list of charges.
    I finally got a reply the other day. The charges i calculated amounted to: £654.00 without interest. And they have offered £428.40. I worked this out to be around 65%. Which i personally believe is ridiculous. However i am a student and therefore i dont really have the time or funds needed to take the whole thing to court. And to be honest the whole court thing worries me a little. Which is probably exactly what they want.

    They also wrote this in their letter:

    "The circumstances in which the fee will apply are set out in our Personal Banking terms and conditions, which you have already recieved. If your claim for a refund proceeded to Court, we therefore believe we would successfully resist any legal challenge in relation to these fees."

    Any way the gist of the letter was take this or leave it...

    Then they wrote:

    " Alternatively, if you wish to escalate your concerns to the next stage, you can write to the Senior Manager of our Service Quality Team, at the following address, enclosing a copy of this letter:

    ....

    Cases we cannot resolve can ultimatley be reffered to the Financial Ombudsman Service, further details of which can be found in our 'Listening to your comments' Leaflet."

    I dont really know what to do??? What do i reply in the letter?

    Any help would be greatly appreciated!!! Regards. JP

    Send them the letter before action and refusal of there offer of the amount as you are seeking the full amount
