    Hi

Send the letter and the charges to:

    HSBC Bank plc
    Service Management
    Arlington Business centre
    Millshaw Park Lane
    Leeds
    LS11 0PP

You should get a reply in about a week saying they are looking into matter, i presume you are sending letter statting that you want a response in two weeks, but you will find they have eight weeks to make you an offer. You can either let this happen (they do generally pay out if you wait 8wks) or you can stick to your timetable and go down the court route, personally i would wait as alot of successes from HSBC have waited and received offer. alot less stressful than preparing for court and dealing with their solicitors. It is entirely up to you. Have a read back through this forum and you will get quite a bit of information from us all.Hopefully you will find it useful with just a bit if hysterical nonsence:rotfl:

    Good luck

P s to be on the safe side send a recorded letter to them and then chase up every two weeks or so for progress report.

thanks for that saved me loads of time..... i'll follow your advice :j
  • Hello all

I've received offers from the Service Quality Team in Leeds, but am not happy with the ones for my wife.

Have any of you had success in negotiating them up, and if so, how have you done it?

I would be so grateful if you could advise.

    Thanks in advance,

    Fred

    What I would do:

1.) Write to the bank and say that now you had to file a court claim due to their delay in dealing with your claim, you will settle only for the whole amount + court fee + interest.

2.) Do NEVER write to the court asking for any cancellation or similar of claim until the money is safely in your account!

3.) The offer came from the bank so they can inform their own solicitors, you don't have to.
    Reclaimed thanks to this site:
£175 Abbey Mortgage Repayment Fee, £170.03 Capital One Bank Charges £418.07 Lloyds TSB Bank Charges, £2,671.55 Mis-sold Endowment Policy, all for OH
  • Hi Fred,

If you don t mind me asking what was she asking and what did she receive?.
Im in the same sort of position even though the offer is good (£1857) claimed £2,3330 i would have like a neat £2k. Some people have received really bad offers, some ok like mine and some for the whole amount.

I really need the money so will be very grateful for what they have offered, might try and ring and negotiate a bit more, but if i have to reply in writing then wait for them to look into then i shall just take the original offer.

The extra £500 that they have kept is for the last two years charges as i never really had any before that date so i still think this is a bit steep.

Anyway sorry to waffle on, as Fred said anyone else had any luck with negotiating.

    Hi,

I'm in the latter stages of the reclaim process: my claim against HSBC has been acknowledged - and from what I've read on here and in CAG it would appear HSBC's solicitors DG will file a defence just before the default time.

My question is twofold really then

today I called the bank as I am about to get charged another swathe of charges amounting £150 (I'm still struggling to bring the account in order) the operator went away spoke to a supervisor and one or two minutes later came back and said they'd credit £100 of these charges back to my account?

Firstly, even though the recent charges haven't been mentioned in my court proceedings to date can I still try and claim them back? They were not mentioned as I didn't know I was going to be having the recent spate of difficulty that I have been having!

And secondly wouldn't the fact that the operator went away and about 1-2mins later came back and said we'll wipe out £100 of those charges "imply" that there is a huge profit margin that can be wiped out without high level interaction? i.e. if a call centre supervisor can waive £100 of the fee's it is surely implied that the fees cannot be just covering costs else I'd imagine losing the company money it's already spent dealing with the contract breach would be a big descision (one perhaps a call centre supervisor wouldn't be able to deal with)?

Or am I just clutching at straws?

    Thanks for your input.

  • I have been with HSBC for a number of years, over the past few months my husband and I have been through a rough patch financially and have gone over in our account a number of times each month as well as being charges for unathorised od we have been charged various times for recall of dd's. To top it all off we have just had our first baby and i was very ill after having him and my h had to take time off work, he is a contractor so doesnt get paid for what he doesnt work, i dont work. HSBC wont give us an overdraft because we have zero credit rating, up until a few months ago we were hardly ever overdrawn. could really do with the money now but wasnt sure if i should explan our circumstances when reclaiming or just send the standard letter after all charges are unlawful no matter what the reasons behind getting charged are. Any thoughts or comments greatly appreciated.

Just wanted to say to everyone still mid claim.......KEEP GOING!!

I started all this in Feb with my work friend. She was with the Co-op and got £1900 back within the 8 weeks. I sent all letters to HSBC with no luck so proceeded to the court stage very nervously! 3 days later i got a offer of about £500 less of what i was asking for so accepted as part payment and persued for the rest considering i had then forked out £120. They refused to pay me anything after that, put in a defence and i cr*pped myslef!! Then to make matters worse, the court lost my file, then set a court date for when i am on holiday, finally rearranged the date, only to lose my file again!!!!

Sent off the charges as asked for my D&G and sat and waited......

.............in the mean time i did my boyfriends account with Barclays for him as he couldnt be bothered with all the hassel i was having, 3 weeks later and 1 letter he had £2200 sitting in his account!!!! Talk about rubbing it in!!!!

Anyway, sent one final letter to D&G 2 weeks ago offereing to settle out of court before the court date of august. Fully expected to wait until August to hear anything when today i received a offer letter from D&G for the full wack, interest, court fee and charges, all £1800 of it!

Wooo hooooo!! No more running home to check my post, no more headaches from reading this website everyday!!

So to all you still going, you'll get there in the end. Def send one more offer of a settle letter to D&G as that is what swung it for me i think!!!!

You can always add a little bit about your circumstances to the standard letter. I'm sure the poor bank staff must be heartily sick of reading the same thing day after day. I put an apology for paying late in mine. It didn't make an iota of difference, though. I still had to refuse a part payment and file court claim before they finally paid up in full.
The acquisition of wealth is no longer the driving force in my life. :)

Hi all. I sent my signed acceptance of HSBCs offer to arrive recorded delivery on Tuesday.

I know they say up to 14 days to credit the account, do they normally take this long?

    Should I push it?

I rally need the money now and DEFINATELY need it for the 14th.

    Think its worth calling?

    Many Thanks

    Gary
