Guys - I'd really love some advice as hubbie and I are losing faith in each other and the process. We are claiming around £2,800 in unfair bank charges and with interest on top it's £3,500 ish. We wrote to HSBC to claim the full amount. They sent the "we'll look into it" letter but our 14 day deadline expired and we logged the claim with the courts. A few days later the bank sent an offer of under 50% of the full claim and they cited they didn't agree to/pay the interest and also stated we'd agreed (as a condition of our borrowing on overdraft facilities) to paying interest at the agreed rates on that borrowing. So, am I not entitled to claim this back? The court has written today (acknowledgement of service has been filed) to say HSBC's solicitors (DG Solicitors) indicating intention to defend all claims. We do not want to back out so is it likely we can survive the court case and win? Can anyone help with any facts/figures to quote to help us in court? We are representing ourselves. Thank you everyone who takes the time to respond and congratulations to all who have been successful so far - I wish I hadn't left it so late! :A pixelpops

Sounds like you're at about the same step as me.

If (like me and many others) you are not happy with the 50% offer then it's a polite rejection letter to HSBC (keep a copy) and sit tight. From everything that's posted here so far - they won't arrive at court and judgment will end up in your favour - you will get your cash plus interest or HSBC will pay in full just before the court date.

Don't let the buggars get you down.
We missed out on the reclaim of nearly £5000 bank charges from HSBC, but picked up over £10000 in PPI claims against them instead. I am now debt free and working to help my other half clear hers
  • I have just received a letter from HSBC for two claims

1st I claimed for £1,200 and they have offered £1,530 - including recent charges

2nd I claimed for £925 and they have offered £875

I intend to accept both and very happy - thanks to all who have helped and given advice.

I now have one outstanding letter with HSBC for £485 and now going to start again with Barclays for £380.

    Good luck to everyone

    Claimed - £1470.00
    Offered - £1398.25

I have been reading this site for a few months but never posted. We started our claim against HSBC in April and got the normal 'It will take upto 8 weeks to investigate' letter. After 8 weeks a letter arrived offering 95% of what we were claiming.

On the offer letter it says please allow 14 days for the money to be in the bank. What is everyones experience of this 14 day period.... is it set in stone or is it normally quicker.

    Many Thanks

    Russ and Victoria

I got a letter today telling me that the case had been transfered to my local court - no need to do an allocation questionnaire. I phoned the court and they said I will get a letter from them in the next week but should I do anything in the meantime? It seems taht some people are sending a copy of the charges to DG solicitors - will this give them a bit of a kick to make them realise I am serious? Not sure what to do now....help please!

I could really do with some help here. I am a bit worried about this getting to the court stage and need to know if there is anything I can do to make them realise that I will take this all the way if necessary and therefore encourage them to settle. What have others done when they received a defence and court transfer.

I am claiming for £1520 including interest and court fees. They did offer a settlement of £1071 (charges without interest) but I rejected it as had already started court process so was £120 down.

Please, please, give me some advice....need a bit of motivation as this is all getting a bit serious and scary now...I'm determined to beat them though!

    Thanks

    Hello All,

I have just handed in my court bundle to the court and paid an allocation fee of £100. This brings the total I'm claiming up to £2900 including interest. I have sent two letters prior to the court bundle to D&G solicitors and both were ignored. I have sent them a letter today saying the court will look on any party favourably who makes a decent attempt at settling and will now not accept any less than the full amount. My court hearing is on the 27th Aug and HSBC have untill the 31st of July to put in there court bundle which the judge has asked them to give a full description and Breakdown of how they come to the figure of £25 per charge (which they can't do). Has anyone else had this from the court? If they fail to comply with this..I win. So have the courts found away to stop the banks wasting their time? Or do HSBC put their defence in leaving that part out?

    Anyone Know?

Good Luck everyone.. HANG IN THERE!!!!

Does anyone know for certain if you can claim more than 6 year's charges? I've got every bank statement going way back, with plenty of charges on them. Does the six year limit apply to requesting old bank statements, or reclaiming bank charges? Any advice would be appreciated.

The six year limit is set by law
NATWEST Amount Claimed £2860 Amount Received £2860

CLYDESDALE FINANCIAL SERVICES Amount Claimed £85.00 Amount Received £42.50
