  • I am going through the process with HSBC at the moment and 8 weeks are up on the 18th July. I was just wondering whether or not they will use the money to pay my overdraft and then remove the facility from me? Has anyone had this happen to them?

    Thanks. I did thionk about it for a couple of hours but i'm pretty happy with what I got. I do beleive the banks need to gain a little out of this, and £485 for the mess I got myself into (although no help from HSBC!!) seems a fair deal. I've now sent the letter back today special delivery (cost me nearly £5!! lol) Fingers crossed i see my money soon. One of the gf's friends got hers back in around 5 days from HSBC

    Trace, fingers crossed for you too, i'm positive something will work out for you soon

    Revell, I haven't heard anything about my overdraft been cancelled or amended, nor do I think this is standard practice with HSBC. TBH i wouldn't mind if they did cancel it, as its 1 less debt I have to think about

  • today 3rd of july 2007 HSBC made a offer but yesterday i started Court Proceedings at a cost of £120.

    they offered £1183.05 when i asked for £1314.50 which leaves me wondering of what to do now.

    do i write another letter asking for a further £251.45?(the amount not offered plus court costs)

    or just let the Court decide?

    i gave the bank 2 days extra to reply due to the mail strike on thursday but letter is dated 27th june which was already the 15th day after i sent the final letter.

    Obviously, it all depends on your circumstances and the amount involved (both in real and percentage terms) but, personally, I regard any part offer or payment as an attempt to take some of the charges from you for a second time.

    <O:p</O:pIf it is a full and final settlement, write back to the bank, politely refusing it. Continue your claim.

    If it is a gesture of goodwill, write back to the bank, politely accepting it as a "part payment without prejudice". Continue your claim for the rest.

  • I never thought I would be typing this!:T I recieved an offer letter from HSBC tonight. I asked for £862.00, I did not add into the equation any intrerest as I was not entitled to it. Well 6 weeks later and £767.00 offered which I am going to acccept.
    Just to give others a bit more information, i never rang anyone and only reecieved the one 'we're looking into it' response early into this whole process. All of my charges that I claimed for are over 4 years old and I have not been charged since.
    So to all of you, keep the faith, be patient, It WILL happen!

    P.S. there is no address on the acceptance form, have others sent thier forms to the address in Leeds?

    You don't say if the 1340.50 included interest or not. If not then the offer seems to fit above the typical 85% offer that HSBC are putting out (Around 90%)

    HSBC's offer will be for full and final settlement, so you can either reject or accept. If you want the full amount reject, or if you are happy with the figure, but would like the court fee then i'd ring them tomorrow and haggle. They may refuse, as HSBC do point out that letters will be sent out at the 8 week mark (you didn't say when your original request went in) and they won't respond to 14 day deadlines. Its up to you how you wish to proceed. I'd ring tomorrow to try to get my court fee, but would then prob accept if they included it. 90% of my claim vs waiting for a court date is what you have to consider. If your comfortable for money at the moment, i'd go for it all and see them in court to get the full amount.

    Congrats you got 89% and in a shorter time frame. I think the smaller claims are going through a bit quicker.

    Guys - I'd really love some advice as hubbie and I are losing faith in each other and the process. We are claiming around £2,800 in unfair bank charges and with interest on top it's £3,500 ish. We wrote to HSBC to claim the full amount. They sent the "we'll look into it" letter but our 14 day deadline expired and we logged the claim with the courts. A few days later the bank sent an offer of under 50% of the full claim and they cited they didn't agree to/pay the interest and also stated we'd agreed (as a condition of our borrowing on overdraft facilities) to paying interest at the agreed rates on that borrowing. So, am I not entitled to claim this back? The court has written today (acknowledgement of service has been filed) to say HSBC's solicitors (DG Solicitors) indicating intention to defend all claims. We do not want to back out so is it likely we can survive the court case and win? Can anyone help with any facts/figures to quote to help us in court? We are representing ourselves. Thank you everyone who takes the time to respond and congratulations to all who have been successful so far - I wish I hadn't left it so late! :A pixelpops

    126 days!!! WOW. That is a long time to wait. Yes i'd definately ring in the morning, and start by pointing out you've had to wait 18 weeks for a reply which is way over the 8 weeks. I'd defo be going for the court fee to be added to start with, then see if they'll budge on the rest of the other £130 or so.

    If you want it all and interest i'm afraid its the court route. Just really bad luck you filed the day before your letter
