First post on here so a little nervous.
I sent of my first letter to HSBC on june 22nd with a 14 day deadline.
I have today recieved a reply saying they are looking intto my case.
I am just wondering do I send of the second letter threatening court action which is due this friday or wait to receive a reply from HSBC.
I woukld be very gratefull for any help.

I can hardly believe this result.
16th June 2007. requested statements from First Direct
24st June 2007. Received statements
26th June. 2007. Submitted 2 x claims totalling £1860
2nd July 2007. Received Offer for a total of £1581 (standard 85% of total claimed)
No 8 week delay. No nasty letters. Nothing but helpful and prompt.
No admission of liability but who really cares !
I will be accepting of course.
I appreciate that this is almost uniquely quick for a settlement to be made, and whilst I am quite delighted personally I'd like to wish all of those who are having to wait a hell of a lot longer, and go to the court process in some cases, all the very best with their claims. Keep at it folks. They will pay !!
I am now assisting 3 work colleagues to claim their charges.
Had it not been for this site of course I probably wouldnt even have bothered claiming and certainly wouldnt have known how.So many thanks to the hosts and the people who work so hard to maintain the site.

The letters saying that they are investigating and will reply within 8 weeks are acknowledgements of receipt and attempts to make you give up and go away. The 8 weeks only applies if you refer your claim to the Financial Ombudsman because you haven’t received a reply.
Your first claim letter should give them 14 days to reply. If you have not received an acceptable reply by your deadline, send them the second “Letter Before Action” letter.
<O:p</O:pAt this point, you have to decide between referring your claim to the Financial Ombudsman and starting court proceedings.
If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. They charge the bank involved £400 for each complaint they accept. However, they cannot award interest like a court. Their success rate is good but, if the Financial Ombudsman is unsuccessful or the settlement is unacceptable, you can still start court proceedings.<O:p</O:p
If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, you can then refer your claim to the Financial Ombudsman.
If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.

They have paid interest with previous cases that have gone to court, they have also paid out 100% of the claim. What they have told you is fiction.

They have acknowledged this and put in a defense and so I am taking them to court for the full whack. They have responded to court action but not the letters. A friend of mine also with HSBC was told to wait 6-8 weeks while they looked into it! I want my my money back and I want it now.0

Hi there,
I would like to hear from people who have reclaimed from hsbc, just to get an idea what might happen and for what to do next.
I sent in martins letter to reclaim charges which asked for the full amount of £3478.40, the letter was dated 29 may 2007 and hsbc sent me a letter dated 1 june 2007 saying they were looking into it.
From your past dealings with this and hsbc i would like to try to find out how much they might offer and how long this might take, what then happened re your account with them and what might be my best next move?
Are they going to offer something? should i take it when they do? how much should i agree to? what people have done? and how people have found HSBC re this matter, that sort of thing,
i know it could take 8 weeks and this is only 5 just getting worried already
