I have every intention of rejecting this amount and going full course to claim the full amount.
In the letter there's a form to return, should I wish to accept their (so-called) "generous" offer and they make a statement along the lines of "if we haven't heard anything in 8 weeks we will assume the matter finished".
I have submitted court papers and would have thought that the letter is of no real concern and that any reply I make would be considered as a matter of 'politeness' and general cooperation in the proceedings of the case.
Could someone advise what the correct step would be in rejecting the offer?
Should I write to HSBC telling them "no" ?
Should I copy the court on that letter ?
Thanks in advance.
Write back to the bank, politely (a judge might read it) refusing it. If they haven't actually filed a defence, just keep a copy for your court papers. Continue your claim.

Thats brilliant news , well done. You should be ok if you send them back recorded delivery, only takes a day if you post before 10am (pity the bank takes longer)
Did you get a good offer in end.
Lou
Hi Lou,
I received the following so happy with this.
1st claim £1,206 - offered £1173.85
2nd claim £1328.00 - offered £1121.58
I hope you are successful too - let us know how you get on.0 -
Hi all.
The cutoff for HSBC to reply was Tuesday, I have had nothing yet.
Is it worth calling them and moaning do you think? I have done everything by the book, but they arent playing fair!
Thanks

If you give them an inch, they will take a mile!

It might be worth a quick phonecall just to find out why they haven't responded within the timescale.
Unless they give you a reason your happy with, do as the above post says and take it to the FO.NATWEST Amount Claimed £2860 Amount Received £2860
CLYDESDALE FINANCIAL SERVICES Amount Claimed £85.00 Amount Received £42.500 -

Wife spoke to Hsbc this morning and said that we were not happy with their offers against our claims.
They said that they had the right to with hold 15 - 30% of the claim and don't even entertain paying interest on the claims!(?) Reading through here I don't see that as the case. They have advised us to write back saying what we'd be happy to accept and they will respond.
Any advice? I was going to write and say we'd be happy to settle the claim for charges only and forget the interest.
Views greatly accepted. Thanks0 -
I have put in a claim to get back all my unfair bank charges with HSBC over the last 3 to 4 years since I have banked with them.
The amount was approx £2200 incl interest. I followed the video guide and the letter templates. I put in my first letter on the 29th May 2007 (I know this to be accurate as my wife went in to labour about half an hour after she hand delivered it to our branch). I received a letter or acknowledgement on the 31st of May.
We waited for 14 days as directed and heard nothing more. So we sent the second letter giving them a final 14 days to make an offer of settlement or we'd be making a claim on the HMCS site which was reached yesterday. Now being a reasonable fellow and taking into account we've had some postal issues since yesterday I thought I'd call and quote the ref# that came with the letter of acknowledgement.
I spoke to a very over helpful CS person who stated that the bank has up to 8 weeks to investigate and make an offer which contradicts all that I have read not just here on MSE but on many other consumer sites that are advising on how to tackle bank charges. This CS person then went on to say that all the information on the internet is incorrect and that much of the information that is out there is a misnomer and that I have been mislead. He went on to happily inform me that more people have not had charges refunded than have had them refunded??
I'm at the point where if I was to follow the Video Guide I should be filing a claim with HMCS against my bank for my unfair bank charges. But I'm now thinking should I wait for the 8 weeks that HSBC say they take "up to"??
Am I bottling it?? Are they just trying to play me like a game of Donkey Kong?? Surely HSBC are just trying to buy time - right ?? What should I do now ???0
