Well if they didn't make unlawful charges in the first place, they wouldn't have an influx of claims.
What the Banking Ombudsman has to do with allowing the bank a reasonable amount of time before court action I don't know. You only need satisfy the court that you have taken reasonable time to resolve the issueThey have said that they will contact me within the next 7 days with an offer on my claim, and would ask me to delay court proceedings until I have received the offer and responded, as they are investigating the claim, but had a volume of claims to investigate, they could not tell me what the offer would be, but said in the majority of cases under £1000, they are making good offers.
Sounds like a delaying tactic. In any further communication, make it very clear, the only offer that will stop court proceedings under your timetable would be a full and unconditional refund.0 -
hi all, i'd like a bit of advice/help please regarding what to do,basically i wrote a letter to the hsbc asking them to refund my charges and interest to the value of £1042, i sent this letter out to them on the 27 november, they have taken till the 3rd of january to reply, here's what they wrote
Thank you for your letter dated 27th november 2006 concerning your request for a full refund of bank charges. i apologise for not yet having fully completed my investigation.
I will contact you again by the 1st february 2007 and expect to be able to provide you with a full response at that time.
So what do i do now? are they just trying to drag it out for some reason? any advice much appreciated:D
ps. i used this site for a templete for my letter, and intended to carry on using there step by step guide as to reclaiming my money back, but this reply from them has stumbled me a bit. do i go ahead with the 2nd letter now?

Your first letter should have given them 14 days to respond, why have you waited for them to reply? You need to stick to your timetable or you will find the process drags on much longer as they try to delay you.
Write your second letter immediately and give them a further 14 days. Do not wait for them to reply if they have not offered a full and unconditional refund. After 14 days, proceed to filing a claim against them.0 -

I have only given them 7 days to respond in my second letter as I didn't hear anything when I sent them the 1st, is this ok?

This should be fine. If it goes to court, you have to show you have given the defendant reasonable time to respond and resolve the issue. With all claims I have been involved in, I have always given 14 days in each letter as they were originally taken from the CAG site.0 -

We've been following the quide as set out by Martin to claim back the charges we've had from the HSBC over the past 18 months which amounts to over £1000, we've sent the first two letters and have just received a response saying they will deal with it by the 4th Feb. The question is what do we do now? Should we proceed with court proceedings or wait until they get back to us?

Right now as I type, I am printing off ALL my personal HSBC bank statements back to 2001 from the internet, [they only go back this far on their site]. I am going to try and claim back all my bank charges.
Does anyone know whether I can also claim these charges back on my business account [also with HSBC].
Both accounts were closed by the bank and the total amounts owed put into another account with a personal loan to pay them off.
Help I'm getting a bit confused with all this
Just finished printing personal statements. I have charges that state 'Interest' and others that state 'Total Charges' varying amounts charged. Thats all the information it gives. These are on all the statements whether I have been in credit or debit. I think at some point I must have had an Authorised Overdraft but it does not say anywhere on the statements if these charges where for Authorised or Unauthorised. What do I do? you can claim back charges on any bank account ,persoanl or business .
You can claim back all hte "unpaid referral fees" ( usually £30-£35 ) along with a few others . There is a thread somewhere which lists all the charges you can claim back .
