    Hi all :T :rotfl: :money:
After months of anticipation i recieved an offer today from DG for £1389.75, my claim was originally £1472.44 including interest and court costs. In the offer letter it does state that they will not pay the first two charges i claimed because 'they are charges for a period in excess of six years prior to commencement of my claim' which is twad because the first letter i wrote to HSBC was dated 16th February. Suffice to say i am going to accept the offer but i am going to ring them first to try and get them to add the other two charges on but i am mindful 'it is money you thought you'd lost forever'. It's been a long road, i thought i was almost there three weeks ago but the court issued a three week stay for myself and DG to sort it out. What's kept me going more than anything is these threads.
There is one thing i became aware of recently that may be important to some. When i was getting my court pack together i tried retrieving electronic proofs of posting for letters that i'd sent (everything went recorded delivery). I could'nt find any of them on the Royal Mail web site. When i rang them i was told that sending things recorded delivery does not guarantee delivery and some companies bulk sign so you will never get a receipt. Silly really that you pay extra money to make sure something gets there but then you find that it's no guarantee. A friend of mine is a postman and he told me that he's seen collegues take the stickers off envelopes so they don't have to wait to get mail signed for. Be aware!!
Finally thank you soooo much Martin for all the advice and for the help i've received on the threads i wouldn't have done this otherwise and it's felt good to bite back. I'm now taking on Halifax and GE Money.
Good luck to everyone else who's not quyite there yet, hang on in there it really does work.

Hey...First of all, CONGRATS!!! I love to hear success stories :)
I just wanted to know, at what stage were you when they offered you this payment? Reason I ask is because HSBC have just put in a defence with my claim, and Im kinda gettin a bit worried, Im in the process of getting my court bundle together, but I guess I just want some reassurance that it wont go that far!!

If you aren't already, then register with HSBC internet banking. I sent a message through that a few days back, and received a reply in 24hrs stating the dates they received my first 2 letters and they were dealing with it. They HAVE to reply within 48hrs as per their own T&C's. Prob the best way to get in touch, but don't expect anything other than a standard response telling you they have another 4 weeks (which your already aware of)

If they have ignored your requests for repayment then I would issue a claim on MCOL, Lloyds did this to me ignored all 3 letters I sent them so I began my court claim against them on 16th May, their ignorance is one of many stalling tactics the banks use,

    Kez

I can guarantee you that they will last it out as long as possible. I started the whole process against First Direct (part of HSBC) on 14th February. My MCOL was issued about 6 weeks ago, acknowledged with intention to defend and then transferred to my local court (Swansea). At the beginning of this week I got notification that the claim was being transferred to Cardiff. After all this time, I still don't have a court date and have never been contacted either by HSBC or DG Solicitors to offer a settlement.

I'm dug in and sticking to my guns. But just to warn you that it can take a very long time !!
    Reclaims in progress:

    Smile: Claimed £3124 Paid: £3124

First Direct: Claimed £8178 Paid: Court date 14th Aug

    MBNA CC: Awaiting statements
