I posted a couple of weeks ago to say that I had received an offer and was accepting. I claimed £2168 and was offered 2102.11, which I was thrilled about but when I had gone back over my statements there were 9 charges I'd missed off amounting to another £300 and odd pound, which were in the time frame I was claiming for, when I spoke to DG solicitors they agreed to add that on aswell. The amount I received another offer for was £2437, I faxed it over straight away and the money was in my account by the end of the day!!

I haven't read any other threads for HSBC that have been as fortunate as me to have received their money so quickly (normally 14 days from return of acceptance) so my advice is to everyone going through the court procedure get on to DG Solicitors and where you can deal with them direct.

The numbers I have are as follows:

    phone: 0121 455 2701, 0121 455 2660

    fax: 0121 455 2771, 0121 455 2150

I hope this is helpful, obviously continue with your court bundles etc in the meantime but by contacting them directly, as I did, you may save yourself an awful lot of time and paperwork.

They're alot more helpful than the usual HSBC staff.

    Good luck x

Can you tell me how far you had got with your claim against HSBC?? I have got a court date for July.......might give them a call and keep mu fingers crossed!

    Thanks

We've not heard anything from our court or anywhere else for that matter, we filed on MCOL and they put a defence in and since niothing, zip!! I sent a letter to the solicitors saying how mindful I was about the sheer volume of these cases etc and we would be willing to settle etc for... but no reply not even an acknowldgement.

Anyone else had this? Its been almost 2 months now since they entered a defence.

Phoned court today to see when I would receive a hearing date. They said DG/HSBC had not filed the AQ on time and it was now late. I asked what did that mean and was told they would probably give them another 2 weeks to get it in !!!!!! Why do I have to get mine in on time but they don't ? I sthis legal or can I try to claim judgement as they have not kept to the court timescale ? Seems unfair if I can't. What do people think ?
    Any advise welcomed.
    Thanks.

i think i have added up my charges wrong, and incorporated some intrest charges for my overdraft, although since i filed my claim with mcol they have taken another 450 from me which evens it out, i am at the acknowledge claim stage should i contact the court and let them know or dg solicitors and could this ruin my claim?
    any help appreciated
    thanks

After two long months, I feel like Im finally gettin somewhere, but I feel a little nervous now, as HSBC put in a defence with MCOL today...does anyone have any advice for me on what to do next?
I havent had a letter from the solicitors yet, I just had a letter last week from HSBC telling me all acknowledgement will be from their Solicitors from now forward.
What exactly does my court bundle involve, Ive seen it on the CAG website, but it doesnt make much sense to me? Is it basically all correspondences from me to the bank and vice versa?
Also I have HSBC terms & conditions which I printed off today...Does it make any kind of difference that I was only 15 when I opened my account, and I called and asked them for a copy of my contract, but they dont have it on file anymore???

hi everyone, im claiming £409 from hsbc and have filed with mcol. hsbc have defended and am waiting to hear from court. i called dg solicitors today and left a message asking them to give me a call back and gave them my mobile number.
later on i recieved a call on my mobile regarding a missed credit card payment which i missed a couple of weeks ago, and im quite sure i have never given hsbc this number!!!! i have missed a couple of payments before and paid at end of month but they have never contacted me. i just think its very strange
dg solicitors never called me back either!!

    I'm one step closer!

I got my court date for August 22nd at 2pm after weeks of waiting, so hopefully a resolution is in sight.

I've been asked to supply the usual stuff, statements etc but I have been also asked for, and I quote:

    c) Statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise.

    D) Copies of decided cases and other legal materials to be relied upon

Questions - For point C, what should I be sending? For point D, I don't think any bank has actually turned up at court and lost yet have they? So what do I put here?

I did have a little chuckle when I saw that the bank have been asked for the following:

    B) whether such charge is accepted to be a penalty, and if not why not?

    C) If such charge is alleged to be a pre-estimate of the Defendant's loss incurred by the Claimant's actions (whether or not such action is to be treated as a breach of contract between the parties), all facts and matters intended to be relied upon as showing that such is a proper estimate of such loss, and all evidence to be adduced at trial as to what the true cost of dealing with the matter was.

So, from that I take that as long as I get my bundle in I will win because the bank are never going to answer C are they?!

    :p to HSBC I say!

With the court bundle, do I have to copy the 'Authorities' 3 times too ie- The unfair terms, supply of goods & services etc...As its ALOT of ink and paper to be wasting? Or do I just have 1 copy for myself?

    THANKS for any advice given

I have just received a 'Without prejudice' letter from HSBC for £391 out of the £441 I asked for. Very impressed.

They say in the letter to return the signed sheet within 10 working days but they dont give an address to send it to!

Is it the address at the bottom of the letter, HSBC Bank PLC, Service Management - CPT, Arlington Bus Ctr, Millshaw Pk Lane, Leeds, LS11 0PP ?

Here's scans of my letter, to see if you can find a different address to post it to - Dont want it going to the wrong one and me not getting £390!

Firstly congratulations. I would say its that address as thats the only one that is dealing with the claims. To be on the safe side i would phone them and confirm it with them. Also i would send it back recorded delivery just in case.

well done i hope i shall be posting something similar too
