Well im sticking to my timelines and my LBA is off in the post tomorrow morning recorded delivery!
Im going down the without prejudice route and have suggested they refund me the amount without interest otherwise its the court route.
Has anyone else done this and got a result?
Im assuming HSBC will still be sticking to the eight week turnaround they now have so Im hedging my bets Ill get ignored and by the time the MCOL starts to go through I might be getting a reply or an offer!

I got my statements within two weeks.
21st March - Wrote to them asking for £1560 back.
29th March - They wrote to may saying that they were investigating and would get back to me. (enclosing a leaflet saying that they had 8 weeks to respond and if i didn't hear back I could go to the ombudsman)
24th May (8 weeks) - I called them as I'd not heard anything. Woman gave me an email address for the quality team. I emailed them.
25th May - Called them again and a woman said that I had an offer letter in the post for £1660 (total requested back + charges incurred in the interim).
30th May - they received my signed acceptance form - they now have 14 days to deposit the money in my account.
I used all the templates and message boards from Money Saving Expert. Basically it's worth being patient up until you have run out of deadlines or they give you a rubbish offer before going to court. Patience and politeness helped me I think...

My claim for just over £2000 has got to the court stage, I have been waiting to hear about a court date. However I got this letter this morning from the court.
Ex Parte
IT IS ORDERED THAT
The court of its own motion is considering striking out the defence in this action as an abuse of process.
The basis for this is the fact that the Defendant is settling all claims of this nature where Claimants are seeking reimbursement of Bank Charges, with no claims proceeding to a contested hearing.
The Court considers the authority of Mullen -v- Hackney London Borough Council (1997) 2 A11ER 906 relevant.
If the defendant objects to the proposed strike out it is ordered to file, within 14 days of the date of service of this order, a schedule setting out all claims of this type in England and Wales which have proceeded to a final contested hearing, and the outcome of such hearings, together with a schedule of all such claims which it has compromised before final hearing, after proceedings have been issued.
Upon receipt of any such objections the Court will consider listing the claim for an on notice hearing of the strike out issue.
In the absence of any such objections being filed in time, the Defence herein will be struck out and judgement entered for the amount claimed by the claimant, together with the appropriate costs claimable on the small claims track.

That sounds really promising, which court is this? I have a pre trial hearing set for August 14th in Cardiff, i hope i get this letter!

Well done. I am half way through the eight week wait, have been emailing them to let them know im still around though. Not getting any response from them i have an e mail address for them but am starting to wonder if its th right one. can you tell me which one you have been using

I am claiming £1300.00 - The banks solicitors have asked for a detailed breakdown (which I sent 2 weeks ago). However, I have had no response.
Will the bank settle before the court date, or will I have to go to court. I am not confident if it does get to court (as I dont really know the current law etc)

I posted a couple of weeks ago to say that I had received an offer and was accepting. I claimed £2168 and was offered 2102.11, which I was thrilled about but when I had gone back over my statements there were 9 charges I'd missed off amounting to another £300 and odd pound, which were in the time frame I was claiming for, when I spoke to DG solicitors they agreed to add that on aswell. The amount I received another offer for was £2437, I faxed it over straight away and the money was in my account by the end of the day!!
I haven't read any other threads for HSBC that have been as fortunate as me to have received their money so quickly (normally 14 days from return of acceptance) so my advice is to everyone going through the court procedure get on to DG Solicitors and where you can deal with them direct.

I hope this is helpful, obviously continue with your court bundles etc in the meantime but by contacting them directly, as I did, you may save yourself an awful lot of time and paperwork.

The chances are that the bank will either settle in full, or offer a part settlement, probably immediately before the court date just to make things difficult.
If you haven't done so already, the next step is to start getting your court bundle up together, just in case their offer is unacceptable. This is basically three copies of everything you already have: your list of charges, your letters to the bank and any letters from the bank. Depending on the actual defence, you might need some other more legal documents, but we can tell you what you need and where to find them. One set of copies will be waste paper, because the bank’s solicitors won’t turn up. They daren’t. The last thing they want is to have to answer some potentially very expensive questions, such as just how little it does cost them to administer a late payment, overdraft, etc.
