    I am also going to look at the CAG court bundle and prepare my case. People say it won't get as far as court but I'm not taking the risk.

    I think the counterclaim was a copy of what was sent to HSBC. It is not for you to fill out. You are already the Claimant.

    Please can someone advise whether we just sit and wait for a court date?
    Or a) contact the court
    b) write to D&G?

  • This is the standard HSBC defence. Nothing to worry about. They are using the 'service charge' argument by implying the charges are not penalties in themselves but legitimate service charges.

    The next stage it to wait for a court date to be set - you'll also probably be contacted by DG solicitors asking for a detailed list of your charges - although they are extremely slow so this may take some time.

    HSBC have not (to my knowledge) taken anybody all the way and have always settled before the court date. They do like to drag it our for as long as possible.

    Bring it on!

    I was scared when I saw that it might actually go to court but your advice and all the other people on here who have recieved their money back make me more determined.

    Phoning the court is a good idea - they're very helpful and it's good to know what's going on.

    I phoned the court (central london) last week to enquire about my court date as I had not heard anything for weeks - they told me my date should be set this week.

    I had a chat with the clerk about bank charges cases in general and he said that they will be 'block-listing' the cases to get them dealt with efficiently - as he described the number of claims as 'mental' ;)

    just phoned my bank as they have put another £125.00 charges on to come out next week, asked them if they could stop this as at present am wthin my overdraft and if they take this they will make me overdrawn again. Told them i was to loose my home because of all this, the response i got was that i don t meet the right criteria for the charges to be dropped. The money i told them was my child benefit and tax credits which puts food on the table for my children and pays my rent, if i dont use this money and they take it as charges how am i suppose to live. She then said i could apply for an emergence credit card. I Declined !!!!!! :mad: Another £125.00 now i shall have to add to my charges that i am in process of claiming back.

    Any advice out there.

    I have today recieved a letter from the court saying that:

    "Unless the defendant files an Allocation Questionnaire by 4pm on 8th June the defence will be struck out without further order of the court"

    Does this mean if they fail i win?

    What happens if they file an Allocation Questionnaire?

    I have my court date set for 1400hrs 29th June with HSBC. I'm claiming jst under £3000. I've sent my court bundle off to DG Solicitors and my local County Court...which was a nightmare putting together but all done an dusted now...
    I was jst wondering if anyone has actually got as far as court with HSBC yet?? Or has everyone else had their money thru jst before the court date>??

    I'm really starting to get scared now!! :eek:

    Anyone else got a court date with HSBC anytime soon? Would love to know how others are getting on!

    I had this letter too, I took it to mean they had until 4pm on that date to get their act together and get the AQ into court.....which unfortunately in my case they did! They got it to court that morning :mad: ....And so it goes on... :rolleyes:

    I think they may be looking at and paying out on business accounts a lot quicker. I originally sent a request for a refund for charges from 3 accounts to my branch - 2 personal accounts and 1 business. Got a reply from Leeds for the 2 personal accounts, and still going through the 8 week wait period, but got a reply from "Commercial Core Products" in London about the Business Account.Sent my original request and details of charges on 9th April, had first letter from "Commercial Core" dated 20th April, offer of settlement 30th April (refused), followed by an offer just short of the amount claimed, and cheque received 25th May.

    Sadly the business account fees were from £168, whilst the other 2 account total more than £3000!

    New starter here.

    Just sent to FD for statements.

    Checked my online statements for First Direct and there's not that much there to claim as they only go back to March 2005 and I've been a bit better with money since 2005 Most of my charges were on old accounts in the 3 years previous to this when I had lots and lots of problems and charges.

    Will First Direct provide statements for dead accounts. Even if they were jointly held with someone I am no longer in touch with ?

    Ive asked for statements for all current accounts I have used with them in the last 6 years. Will they comply or are they likely to say they cant retrieve archived records ?
