    The letter i got was A Notice that a Defence Has Been Filed from the court, enclosing a copy of the defense and an AQ to fill in . Hope that helps

    Would really appreciate some advice as have read conflicting reports of how to proceed from here.
    I have done the MCOl and DG have entered their defence on day 28!! no surprise there really. What would you experienced campaigners recomend I do now. Should I sit tight or be pro active and write to DG again asking to settle claim before court date?

    Hi folks

    I have followed all Martin's advice up to now and lodged a case with mcol. HSBC lodged a defence 18 days ago. Yesterday I received an offer from HSBC for 90% of what I had claimed. I would be quite happy to accept this especially with some of the recent court decisions, but since the amount is approx £800, the £120 mcol fee that I have paid is a good proportion of this.

    The question is should I reject and risk going for 100% plus interest plus costs or should I try and negotiate a better figure with HSBC?

    You now have to wait for the court to send you your court hearing date and a copy of the defence.

    The only thing we can do is to see it through and hopefully we can get our money back and keep our accounts in credit. I shall be so pleased to be able to pay a few bills off as i have been paying everything at the minimum amount to try not to go overdrawn but alass still managed to a bit, thats why again they are putting more charges on making me go overdrawn again. They told me at the bank that if i didn t touch my account for two weeks (make seperate arrangements for DD then i shall be within my overdraft (which is only £200!!!!) so tell me how am i suppose to pay bills and put food on the table. If just for once they had let me have an overdraft for £300 then i wouldn t be in this position . Its completely mad. Sorry to natter on but its constantly on my mind at mo. How far have you got with your claim?

    It amazes me how they are dealing with everyones claim differently apart from the standard eight weeks letter to investigate. They pay out to some the whole amount, some an offer, some to court. I wish i knew why .

    Think i ve got it all off my chest now, sorry if ive gone on a bit.

    Hi Lou. I have filed 2 claims with HSBC. One for £3438 + interest and the second one has been in two parts, one part for £300 and one part for £700 + interest. I initially sent the letter requesting a list of charges inc £10 cheque (which they have cashed), but decided to go online and work out my own charges. Last Wednesday I sent both claims by recorded delivery direct to the Service Quality Team. I emailed them friday asking them to acknowledge receipt of my claims. I am really hoping that they make me a reasonable offer in 8 weeks and I don't have to take it to the court stage. In the meantime I am unable to access any funds that are being paid in to either account as they are being eaten up by the overdraft and alot of my dds have been cancelled by them so I'm having to TRY and find funds to pay them too. It makes me laugh that on the bottom of all their letters re overdrafts etc they always say something like 'phone us if you need help with your finances', that's a laugh, they've never done anything to help me!!!

    Sorry, that's me nattering on now!

    Let's keep our fingers crossed and hope we both get good results!

    As you have paid the court fees, tell them you'll accept their offer plus the court fees as you would be entitled to them if you continued to court.

    Lets hope so !!! I sent off for statements same as you but gave up waiting and went online. They never charged me for my statements returned £10.00 cheque !! Wonder why again they charge some and not others. I phoned them two wks after claiming money back, told to wait eight wks same as you, got approx 4wks left going by the date of my letter, but they have said its 8 wks from when they process letter their end, might be worth you ringing them to confirm its been put on system.

    My head is spinning with it:confused:
    Its been the longest three months..... success is nearly insight:T ....... Money in account :beer:

    Claimed : £3368 ( £ 3980 with interest )

    Recieved : £3150

    Sent first letter requesting refund on 05/03/2007, recieved letter from bank on 16/03/2007, looking into it, due to financial constraint unable to persue through mcol so left second letter until I could afford to follow through on the threat of court, at this point realiswed it had been 7 weeks, so thought would give them the extra one before carrying on. On 08/05/2007 recieved offer of £2830.93, foned HSBC on 14/05/2007 and negotiate a settlement of £3150, letter recieved date 16/05/2007 with this offer, acceptance letter signed then fax'd and sent recorded delivery, monies credit as refund of charges on 01/06/2007... :beer: :j :T

    Hi all, I need some advice please! I am at the mcol stage with HSBC I issued a claim on the 1st may which was deemd to be served by the 6th of May. The HSBC acknowledged (3/may/07) but now as its day 29 & they've not yet put in a defence I have tried to get judgment by default online but the system says I can't do this yet. Is it 28 days from the date the claim was served ie 6th of May or am I missing something? Also I can't get through to mcol either by email or phone! Has anyone else had any problems with mcol service?
