    to be honest id accept anything over 1000 ish so if they make me an offer id rather take it and save a load of hastle

Further the charges are not default charges and accordingly, cannot amount to a penalty.
    5. Save as set out above, each and every allegation made by the Claimant is denied. For the reasons set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.

    Serious. I guess I just need reassurance that other people have had the same response??

    Do I just wait for a date now? Or contact the court?

    I am at this position to.

    I will start doing the court bundle, but can anyone explain their defence above?

    And does a court date follow this letter i received? As the letter had a counterclaim form attached to. Do i fill this out??

    Im claiming for £1300, and would like to go all the way and not stop here.

  • This is the standard HSBC defence. Nothing to worry about. They are using the 'service charge' argument by implying the charges are not penalties in themselves but legitimate service charges.

    The next stage it to wait for a court date to be set - you'll also probably be contacted by DG solicitors asking for a detailed list of your charges - although they are extremely slow so this may take some time.

    HSBC have not (to my knowledge) taken anybody all the way and have always settled before the court date. They do like to drag it our for as long as possible.

    Same here, i received exactly the same letter on 16th May. They said they had 8wks from the date they processed the letter. I m at the stage too where im not sure if i should do lbc letter or wait the eight weeks, or maybe write a polite letter to see if i can hurry things up. Just received more charges of £125 due to come out next week. Should i add these to the amount i want to try and claim back or phone them and see if they will drop the charges this month, I should then be within my overdraft . Any help appreciated:confused:

    This letter is now about a month old so what should i do now ? Ive looked through some of the threads but they are so big i was having trouble filtering out the good info from the inappropriate.

    Hi sorry can i just ask has HSBC every made you any offer, and did you wait the 8wk while they investigate?. I am just trying to find out if they are making customers go down the court road when they refuse an offer or don t wait the 8wk. Sorry if this question has already been asked

  • Hi Fellow warriors,

    I registered a claim with MCOL for £2200 on April 26th, and HSBC acknowledged 1st May. When I checked on the 25th May they had filed a defence, but I have not received any paperwork since? I am guessing that I will get a transfer of proceedings notice - anyone know how long this may take to come through - or should I have received this already?

    I have just asked for judgement by default on mcol as HSBC have filed no defence so I'll wait & see if they pay up!

    i been waiting 9 weeks :mad: now had no reply at all from any of my letters havnt the cash to take to court yet been messaging them online had replys back from each one sent sayin gthe same dealing with it :mad: have any one got a number to phone them on insted of the stupid 0845 number please thanx xxx tamie

    Sod's law im away for 2 weeks next week, so i may phone the court to see if a date is set.
