    You will need to ask the bank what this is.

  • So HSBC decided to defend weeks ago. Warrington court have asked for a breakdown of charges and statements to back this up. Sent these off a week ago. Just recieved a letter from their solicitors asking for the same breakdown of charges and statements to prove. Also threatening that it will slow down the process if I delay.

    Now am I right to send them an very insulting reply in that THEY ( the bank ) need statements from me? This is just time wasting on a stick! I am tempted to charge the for my admin time!

    I presume that the court will just judge against HSBC if they dont get their defence in in time?

    I am not playing stupid games with small time solicitors who think they can drag it out even longer!

    The bank will check your claim and will likely throw out the whole claim on the basis of you reclaiming charges that have already been refunded.

    Also, could you tell me where to send this 1st claim letter ??

    I spoke to a HSBC phone operative yesterday and they advised me to send the correspondance to Service Quality Team in Leeds :

    If they have suggested that address I would say that is probably the one to send it to.

    If you don't send the information they ask for its likely that you will be the one who ends up time wasting to be honest. Send them what they ask for.
    This will be part of your court bundle that needs to be done anyway, see Martin's article for the link to CAG for the Court Bundle.

    Hi all,

    Would appreciate some advice. I've reached the end of the 14 day period of the 2nd letter with HSBC (original letter sent 10/04/07) I received a standard ack letter after the 1st letter but nothing since. Do I file a court claim now? The thing is I owe HSBC approx £4k, would this stop them paying back my charges? In the 1st letter I requested they deduct the amount they owe me in charges off my total debt but I've not had a reply to this.

    Any help would be appreciated.

    The only thing we can do is to see it through and hopefully we can get our money back and keep our accounts in credit. I shall be so pleased to be able to pay a few bills off as i have been paying everything at the minimum amount to try not to go overdrawn but alass still managed to a bit, thats why again they are putting more charges on making me go overdrawn again. They told me at the bank that if i didn t touch my account for two weeks (make seperate arrangements for DD then i shall be within my overdraft (which is only £200!!!!) so tell me how am i suppose to pay bills and put food on the table. If just for once they had let me have an overdraft for £300 then i wouldn t be in this position . Its completely mad. Sorry to natter on but its constantly on my mind at mo. How far have you got with your claim?

    It amazes me how they are dealing with everyones claim differently apart from the standard eight weeks letter to investigate. They pay out to some the whole amount, some an offer, some to court. I wish i knew why .

    Think i ve got it all off my chest now, sorry if ive gone on a bit.

    Hi just a little advice needed really, i accepted a partial refund from HSBC but as i had already issued my claim through my local court advised them i would continue for the rest. They duly acknowledged that they were defending the WHOLE claim, and yesterday i received their standard defence and an AQ which has to be returned by the 18th JUne. My question really is should i send the AQ back straight away? Or leave it until nearer the 18th and see what happens in the meantime? Is there anything else i should be doing?

    Send it back now, you'll find a guide in the Reclaim Help Thread and send a list of your charges again and then you'll be seen to be "doing the right thing".

    Well surprise surprise...letter from court today, HSBC have filed a defense, pretty standard same as rest on here, and i now have an AQ to fill in and return by the 18th June..i seem to be a few days behind you...will watch and wait!!

    I have not yet recieved the defence in the post nor have i recieved the aq of the court. The court told me during a phone call to them that a defence had been put into the court on the 24th may.

    Should i have recieved the defence by now because i was on the understanding that i should have recieved the defence at the same time as the court or am i wrong
