    ive sent off both my letters, got the standard response to the first but no response whatsoever to the second (i sent it on 16th may)... im gearing up to make the next move but am now not sure if i should go court or ombudsman.. im only claiming just over £300... any tips on which way to go with hsbc?

    I finally plucked up the courage to ask for my HSBC charges back. :eek:

    All ive sent them is letter number two with a list of dates and charges (£360)

    I think after reading everyone elses posts I need to brush up on what to do next.. I just sent it and crosssed my fingers :eek: :rotfl:

    After months of anticipation i recieved an offer today from DG for £1389.75, my claim was originally £1472.44 including interest and court costs. In the offer letter it does state that they will not pay the first two charges i claimed because 'they are charges for a period in excess of six years prior to commencement of my claim' which is twad because the first letter i wrote to HSBC was dated 16th February. Suffice to say i am going to accept the offer but i am going to ring them first to try and get them to add the other two charges on but i am mindful 'it is money you thought you'd lost forever'. It's been a long road, i thought i was almost there three weeks ago but the court issued a three week stay for myself and DG to sort it out. What's kept me going more than anything is these threads.
    There is one thing i became aware of recently that may be important to some. When i was getting my court pack together i tried retrieving electronic proofs of posting for letters that i'd sent (everything went recorded delivery). I could'nt find any of them on the Royal Mail web site. When i rang them i was told that sending things recorded delivery does not guarantee delivery and some companies bulk sign so you will never get a receipt. Silly really that you pay extra money to make sure something gets there but then you find that it's no guarantee. A friend of mine is a postman and he told me that he's seen collegues take the stickers off envelopes so they don't have to wait to get mail signed for. Be aware!!
    Finally thank you soooo much Martin for all the advice and for the help i've received on the threads i wouldn't have done this otherwise and it's felt good to bite back. I'm now taking on Halifax and GE Money.
    Good luck to everyone else who's not quyite there yet, hang on in there it really does work.

    Morning all

    I had to wait until today to be able to enter judgement by default, but HSBC have put in a defence this morning:mad: !!!
    My date is not until 31st August and i was kind of relying on judgement this week and my refund paid in the next couple of weeks.
    Is there anything i can do? Im considering contacing their solicitors and negotiating. I havnt actually read the particulars of their defence as it hasnt arrived yet, but the ocal court has told me it has been entered.

    Has anyone negotiated with the solicitors and agreed a pay out? Or is this not advisable??

    I dont really want to have to go to court as it sounds just too scary! Although of course i will if necessary. But ultimately i am skint and need the money yesterday!

    Any advice will be greatly appreciated.

    Hi, Can i ask, did you contact the solicitors to negotiate the claim at all? Did you get defence entered and a court date?

    I am in exactly the same boat as haychee! I filed my judgement by default on the 5th of June and when I logged on this morning it had been rejected as the HSBC had put in a defence on the same day! I am now panicking a bit as I too find the thoguht of having to go to court really scay but of course will have to go if it comes to it. Has anyone else had any similar experiences and or advice on the next step! Help needed desperately please!!!!
  • I have been offered £1946.25 of £2162.50, but this is the claim without interest. I have worked out that the total claim should be £2669.97 with interest. That means they are only offering me 90% of the original claim or 74% of the claim with interest.

    Secondly, I have been offered £810.90 of £861, but this is the claim without interest. I have worked out that the total claim should be £1020.16 with interest. That means they are only offering me 94% of the original claim or 79% of the claim with interest.

    Should I accept it, or fight for some more money in a better deal? I was thinking that I would accept 90% of the amounts with interest.

    Hi everyone,

    Like most people here i've been travelling the long road of reclaiming charges from HSBC for months now, and 2 weeks ago i received the now common, transfer of proceedings letter/ AQ dispensed with letter.

    My question is this, how long between the Aq dispensed with letter and an actual notification of a court date?

    Is there a time limit to where i can request some kind of judgement by default?

    Any advice would be appreciated, at this stage i feel i am reaching the end.

  • Hi . Try and stay positive, you will get there in then end. Sorry i can t give any more advise than that but im not at that stage yet. Im giving them the eight weeks to investigate, 4 weeks to go, but am constantly e mailing them.

    Can I ask please, did you go down this route, or did you proceed with court letter and sticking to your own time limits of 2wks, or did you receive offer and turn it down.?
