Good morning,
I am new to this forum, and was just wondering if someone could help me.
After filing claim on MCOL, and HSBC putting in a defence, the case was transfered to Boston County Court.
I received the first letter from Boston County Court this morning, dated June 1st 2007.
I am a little confused as to the wording.
IT IS ORDERED THAT
1. This claim be stayed for 28 days from the service of this order for settlement, the Claimant to notify the Court of the current position on expiry of the stay.
I have searched through this thread but not seen anything similar. Could please someone explain to me exactly what this means.

I have got to the stage of taking HSBC to court for approx £1600. They have now told me that their solicitors are dealing the claim. Has anyone else got this far? What do I need to do now?

hi i got the same letter from HSBC. how are u doing your claim, on mcol or at your local court?
has hsbc acknowledged your claim, they have 14 days to do so and if they do they then have 28 days to enter a defence , this will all then get transferred to your local court.
i spoke to hsbcs solicitors and they advised to send them a list of all my charges and dates as they dont start looking at claims till they have had these.it will just speed up process a bit.0 -
hello hope someone can help me.
ive had my notice of transfer of proceedings through the post today and im not sure what to do next. the letter doesnt actually tell me to do anything, do i have to wait to hear from my local court?
also i would love a bit of reassurance im so nervous after reading hsbcs defence. it states that:
1.the claimants account is covered by terms & conditions
2.pursuant to the defendants terms & conditions the defendant is entitled to make a charge for its services as set out in defendants pricelist including overdraft review fee for considering whether to provide and providing an overdraft.
3.the defendant denies that the charges applied to the claimants account amount to penalties at common law and unfair terms in regualtion 1999
4.the charges applied to defendants account are resonable and represent the contractually agreed price for the services provided and the UTCCRS arent applicable to them further the charges are not default charges and accordingly cannnot amount to a penalty.
im really worried about statement no.4 my charges were total charges applied at the end of each month for going overdrawn. i can claim these cant i????
i also had one called charge. could someone let me know???

I received my full and final settlement letter last week which i have sent back signed. On the letter it says that the funds will be credited to my account within the next 14 days. Does anyone know how long this is taking? Are they paying out on the 14th day or earlier? I'd be interested to see what timescales you have all had.0 -

i am claiming through money claim on line. i got the letter saying that the defendant had 28 days to file a defence on 21 may. i assumed that hsbc would have given all the details to their solicitors, so why should i need to contact them (the solicitors)? i am going to wait for the 28 days and see what defence the file. if they do not file within the 28 days where do i stand?

hi, if HSBC dont file a defence within these days then you have won and can press the judgment button. chances are they will file within the 28 days or even on the 28th day. this is what they seem to be doing they did it to me and loads of others which you'll notice if you read through a few earlier threads.after then you will get it transferred to your local court and this is the stage im at. i then called dg solicitors to see if HSBC would be prepared to settle out of court and the solicitors told me to send them a list of my charges as HSBC dont pass these on and this is the next step they would've taken (asking me to send alist of charges)
i did wait the 28 days though, but if you send them this list after the 28 days then it will speed things up a bit and it saves them sending out a letter to you asking for them.after this stage i havent got a clue what to do next!!!0 -

I finally got around to sending my first letter outlining what I wanted to claim back and a spreadsheet listing the charges on 22nd May. HSBChave replied within the 14 days as I requested. However I received a reply that stated they are looking into my case and it may take upto 8 weeks to sort. What next? Do I wait it out?0 -
Hi Dan. You can either wait the 8 weeks or in the meantime opt for the court route which may take longer. There have been plenty that have been paid out in full (without interest) or nearly in full by just waiting the 8 weeks. However, if you want to claim for the interest you will need to proceed with court action. However, if once you do this HSBC Service Management will no longer deal with this, it will be passed to their solicitors and it may add weeks to your claim. Both ways have succeeded in successful claims so it is entirely up to you which route you wish to take. Personally I am waiting the 8 weeks, i could not cope with the court route and am hoping that i get a satisfactory offer within the 8 week period. My first claim reaches 8 weeks on July 9th so I am hoping I will be able to post a positive result!
