It will be posted. However, the legal jargon they will use is designed to intimidate you into giving up. When you receive it, post it here and someone will translate it for you.
The next step is to start getting your court bundle up together. This is basically three copies of everything you already have: your list of charges, your letters to the bank and any letters from the bank. Depending on the actual defence, you might need some other more legal documents, but we can tell you what you need and where to find them.
One set of copies will be waste paper, because the bank’s solicitors won’t turn up. They daren’t. The last thing they want is to have to answer some potentially very expensive questions, such as just how much (or how little) it does cost them to automatically administer a late payment, overdraft, etc.The acquisition of wealth is no longer the driving force in my life.0 -
In fact the next step is to wait to hear from the court and/or the bank's solicitor. You'll be sent the defence and may be asked for further details. If you are asked for these, send them along with your POC, use the longer version in the Reclaim Help Thread.
You'll find links to relevant threads in the Reclaim Help Thread such as if you have a letter from the solicitor or the Allocation Questionnaire has been dispensed with.
However what you are really hoping for is a resolution before you get to court so have a read through previous posts here as I think HSBC will negotiate.0 -

I have sent my letter to the HSBC requesting the repayment of my bank charges.
They have getting back to me saying that they are looking into the matters raised and i will respond to you with a full response as soon as i have completed my investigations.
But how long does this take????, it doesn't say within there letter!!!, or should i stay with my deadlines set out in martins letters.0 -

i had them file a defence, ive been told that we dont pay any charges in court if you lose so put up a fight as i will do when they give me a court date0

Hi Learning - give the court a ring on 1st June to see if they've sent in their AQ. Better still, ring the court today and ask for the form you'll need to send in to request judgement - then you'll be prepared. Unless you hear from the court that the AQ has been received, you won't know about it. The reason they've been given longer by the district judge is that they're keen to be as fair as possible - basically HSBC have been given every opportunity to sort this...

Hi, Im a bit confused about this 8 week business. The stage I am at, is that the 14 days times scale of the second letter is up and I have had no response off the bank therefore I should now go onto the court stage. I have read on here that other people who are claiming off HSBC have rung the bank to ask how their claim is going before going to court, and some have been made an offer after the 8 week period is up (I dont know when that starts from though) and that HSBC dig their heels in if you take them to court. I dont really know what is the best thing to do now, do I ring them, wait for 8 weeks or take them to court? Can anyone give me some advice on what to do now please? Thanks0
