Yes as it sounds like a penalty charge. Given it's low amount I'd suggest passivity in your letters rather than demanding it back.Hamsters have no tact and diplomacy, nor do they want any.0

the 8 weeks are up for hsbc on monday for my claim so thought i would give them a call to remind them that i was still here, the woman informed me that an offer had gone to me 2day but she wasnt allowed to disclose how much. just my luck that its bank hol on mon so will prob have to wait till midweek, but hey ho hopefully it will be worth the wait, the woman actually thanked me for being so nice to her as she wasnt used to it (wonder why) prob cos we are all sick of being robbed by them0

23.03.07 - AQ questionaire returned with fees. Delivered By Hand. Had 28 days from 20.04.07 to return it.
27.04.07 - Telephone court to find out progress. They told me that the bank had not returned their AQ. They should have done within 28 days.
17.05.07 - Telephoned court again. They still had not received AQ from Bank :mad: . Claim would be put before the judge without bank paperwork.
26.05.07 - Letter received from the court as follows, dated 25th May
'Before DISTRICT JUDGE MILLWARD sitting at Maidstone County Court.
Upon the Courts own motion. The Court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it.
IT IS ORDERED THAT
Unless the defendant do file a completed Allocation Questionnaire on or before 01 June2007 the Defence do be struck out and the Claimant do be at liberty to enter Judgement.'
Dated 18th May 2007
Do I leave it till next Friday or do I contact the court and say 'Please, Mr. Judge, but I think the bank have had long enough to file their defence. I had to return my AQ within 28 days, so why let the bank get away with it.
