    Thanks for your response. I need the money by later this year, so not in a rush as such. I have noted the numbers for the service Quality Team dealing with my case form other posts here, so I will just chase them on a regular basis I think. Also while I am claiming £2300, if they were to offer me say £1900 upwards, I would accept it as its money that I thought was gone forever and will nearly pay for my maternity cover anyway.

    Some have obviously allowed the bank the full eight weeks ... for mie, I followed the guide on the BBC which was to send one letter to the bank asking for the money in 14 days or you would file at court without any further warning to the bank. They sent me the same letter, but (as per the guide) as they did not repay the charges within 14 days, filed the claim.

    You may be following the BBC website information, which in many ways is very flawed, but on here we recommend Martin's step by step guide which includes a second letter giving the bank warning of taking them to court.

    This doesn't necessarily mean giving the bank 8 weeks to respond but is good practice to give the bank notice that you are taking them to court.

    Seems like a sensible idea, but I have travelled past that point now and by all accounts seem to have reached the same junction as everyone else, though a slightly different route.

    I think that there are a few key elements that you you must take extra care to obide by, write to the bank, provide bank statements and make sure you fill in the court forms correctly whereas things like phone calls and other ad-hoc letters don't seem to make a great deal of difference.

    Also, I think that the route the bank will travel varies according to the amount that you are claining. Seemingly, most people claiming under £1000 seem to get their offer or payment in full rather quickly and with little (by comparison) hassle whereas if you are, like me, claiming near on £5000 then they are staying the course and hoping to shake us off. Personally, I think that they have it the wrong way around ... I would be more likely to have forgotton all about it, if my claim was for a few hundred., but £5000 with interest and costs added is definitely worth the effort.
    We missed out on the reclaim of nearly £5000 bank charges from HSBC, but picked up over £10000 in PPI claims against them instead. I am now debt free and working to help my other half clear hers

    Can anyone advise what I need to do now?

    I wrote to HSBC on 3rd April requesting over 2k (inc interest) back. Got the standard letter from Mr Langdale on 11th April. Heard nothing so sent them the step 4 letter as I hadnt received a satisfactory response and gave them 14 days to respond. This was signed for at the bank on 10th May which means the 14 days are up today and Ive heard nothing.

    Do I give them another weeks grace or phone them?

    Don't give them the week unless you phone them ... doing nothing is perfect for the banks ... they seem to like doing nothing and if you give them the time to do it, they'll use it.

    My $0.02 would be to note down what you want to ask (be polite) and phone them ... if they don't give you a satisfactory answer* then thank them for their time and continue with the court route.

    *By satisfactory, I mean they specify how much they will repay (and you're happy with) and a date by which it will be repayed. If they fob you off, offer a crap amount or don't give a reasonably quick date ... I would not be satisfied.

    Read lots on the forum and see what other are doing and how their stories are going.

  • Bank HSBC..I posted my step 4 letter asking for £956. to hsbc on 5th may got a reply on 17th may (within my 14 days saying) "thank you for your letter dated 5 may 07 i am looking into the matters you have raised and will contact you with a full response as soon as i have completed my investigations"
    are they just stalling now and how much longer will i have to wait where do i go from here any help :confused:

    If you gave them 14 days, then give them 14 days. If they don't pay up in that time move on to the next step.
    Hamsters have no tact and diplomacy, nor do they want any.

    The bank has entered you into their complaints procedure and they are allowed 8 weeks to respond to and deal with a customers complaint as per the guidelines laid down by the FSA. They may reply sooner though. This is only relevant if you were to eventually use the Financial Ombudsman as you would be required to exhaust the banks complaints procedure first.

    If you are using the court route then there is no requirement to follow those timescales yourself. You need only show to the court that you have allowed ample time for them to respond to and deal with your claim. Follow the process laid out in the main article and timescales in the template letters. Good luck :)
