Seriously 10/10 for this post!
Thanks for the 10/10!
I was really nervous in speaking to DG Solicitors in the first place but I have spoken to three different guys there now and they've all been great. I couldn't believe how frank he was about the system they're following, but they're probably speaking to hundreds of us a week, so obviously if they reassure us a bit then we're less likely to keep calling.
I realised the are just a legal department of HSBC basically but much friendlier than the ones from the 'quality service team', I feel the 'quality service' is a bit of a myth really. But we shall see, I've been praising DG but knowing my luck they'll probably come back with a really low offer after all this.0 -
Same problem here. I've left 3 messages for DG and not had a call back. Seems they might start being as stubborn and unhelpful as HSBC.
I don't know if this will help but each time I called I left a message at about 8am, gave them my mobile, and got a call back at around 4pm. That has happened three times, all last week. Just keep trying every morning and someone should surely come back to you.0 -
Hi. Please could anyone advise me as to what to do? I have gone to court through MCO as directed - HSBC acnowledged my claim - and today I have recieved an "offer" of £1215.08 - as they say that the interest I have claimed for is "Inappropriate." I have a managed loan account with them from when I was a student with a debit balance of £15595. I am panicing now as I have no idea whether I should carry on and go to court for the total amount including interest - or should I just accept what they offer? If I do accept are they liable to then demand that I pay back my loan account in full? (Which I cant.) Ive read through alot of the other posts relating to HSBC acounts but still dont know what I should do. Im so panic-stricken I almost wish that I hadnt started the ball rolling.
If anyone can help I would be very grateful.

Success - received offer of full settlement today. They have just received my court bundle so the advice is to send that bundle in asap when asked by the court to do so. I took a while to send mine due to workload.
Does anyone have an idea of how long I should expect to wait before money is deposited in my account?Lou0 -

It's up to you whether you really want to go for the interest or not, but you do want your court costs added on I would say.
If you have managed your loan ok with them I can't see them asking for the total of the loan repaid immediately. I've been viewing these threads on and off since Feb and I haven't seen any stating they have had to pay back a loan because they've asked for the charges back. Although I have read of cases where they have off-set the amount against an existing loan.
I personally also have a loan with HSBC, which I couldn't afford to pay back straight away if they requested it, but I'm not letting it stop me getting back my money. If they do insist in off-setting it against the amount I owe them then I'll cross that bridge when I come to it but regardless, don't feel sorry that you've started this. That's exactly how they want you to feel, that way you won't pursue it.
Many have haggled over the phone for more money, perhaps you could try. Don't be nervous just think of the money that they've taken from you and the interest they've earnt of it, therefore why is it inappropriate for you to ask for that interest! That's money that should have been sitting in your account not theirs.
Don't stress, this is money you thought was gone forever, your pot is half full now not half empty0 -

thankyou everso much for your reply. Ive been making all of the payments to my managed loan on time - Im just really worried that I might end up worse than i was before (sort of if you see what I mean.) Im getting married in september and this money would REALLY help - im just frightened about what happens if they shut my loan account etc.. bleurgh. But once again, thankyou for your reply0 -

That is terrific! I wondered why you hadn't posted any threads for a while. I had put my court bundle to one side for the mo but I have sent over all the info they need to be getting on with an offer, hopefully. I will get on with it now though on your advice.
That's brilliant news though, well done.:T0 -
Hi, I've just received the defence from HSBC and there is Order attached from Northampton County Court (went through the online system) which states the Judge Ordered that: "The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise."
Our claim has been transferred to our local court and there was no allocation questionnaire enclosed.
Does this just mean that we have skipped the allocation questionnaire? Do I just have to wait for a court date now? Can anyone advise?
Thank you0 -
ooh. also - sorry - i have a brain like a sieve - does anyone have any tips for haggling over the phone? What tack should I take? Etc really - sorry, Im really not good when it comes to haggling - and even more so as I have really misplaced and unnecessary fears of bank people! (I know that they arnt any "better" than me - yet i still have "the fear". Foolish me.
... so any tips would ve most helpful..thankyou to everyone who reads this post

Yes - the judge has recommended skipping the AQ as he/she is aware the banks are settling claims like this and have no intention of going to court.
I'm at this stage too (exactly the same order) - although I haven't heard anything for a month now as the system is clogged up.
DG solicitors will probably send you a letter asking for your spreadsheet of charges in a few weeks (they requested mine last week) - you should send it to them (tip - use their fax number).
After that an offer can come at any time. If they do drag it out it appears that they do eventually pay out between the period of you sending your court bundle in and the court date itself.
As far as I know, nobody has ended up in court with HSBC yet - and there's a very interesting post a few pages back that one of DG's staff told someone by phone that they're overrun with claims and have no intention of taking it to court.0
